For example, 'Capital punishment may be imposed only when the guilt of the person charged is based upon clear and convincing evidence' 'Capital punishment may only be carried out pursuant to a final judgement rendered by a competent court' Things like these essentially mean nothing in the eyes of the law. No court is going to consider itself incompetent. No court is going to say that it's own conviction is not based upon clear and convincing evidence. For these reasons we oppose.' - Archbishop Friar |

Message | clear and convincing evidence would be where all forensic and ohtetr evidence points in favour of the prosecution and it is pretty obvious the person in the dock was capable of such a thing. This merely restricts the deathe penalty to being used in a case of utter conviction for the proscecutions argument. |
