Requirements of the adopter.

The adopter, on the date of submission of the request for adoption, must comply with the following requirements:

(1) have reached the age of majority, except in the case where two (2) persons united in marriage adopt jointly, in which case it will suffice that one of them is of legal age, and the other adopter may be a minor but never Under eighteen (18) years of age;

(2) have legal capacity to act;

(3) be at least fourteen (14) years older than the adopting minor.

In cases where a spouse wishes to adopt a child of the other spouse, it will suffice that at the date of submission of the petition the adoptive parent has at least two (2) years of marriage with the adoptive parent or the spouse Adopter is at least fourteen (14) years older than the adopted minor.

(1) Persons who have been declared incapable by judicial decree for the duration of the incapacity can not be adopters. In the case of a person sentenced to serve a sentence of imprisonment, he may not be a adopter for the duration of the sentence.
(2) Minors who are not emancipated and minors emancipated by judicial decree or by grant of parental rights may be adopted.

The following may not be adopted:

Persons who have reached the age of majority at the date of an adoption decree even when they are minors at the time of the adoption petition can not be adopted. However, an emancipated minor who has not married or a person of legal age may be adopted, provided that some of the following circumstances exist:

(A) When the adoptive parent has resided in the adoptive parents' home before the age of eighteen (18) and has continued to exist at the date of the request for adoption.

(B) When the adoptee is an emancipated minor who has never married.

(C) Persons who are married or have been married, even if they are minors.

(D) An ascendant of an adopter who is a relative by consanguinity or by affinity.

(E) A guardian for his pupil.

(F) A pupil by his guardian, or a guardian by his pupil, until the date of final approval and signed by judicial decree of the general and final accounts of the guardianship.

The adoption decreed in contravention of the provisions of this section will be void.

No one may be adopted by more than one person, unless the adopters are married to each other, in which case they must be adopted jointly.

A spouse may adopt individually in any of the following cases:

(1) When you wish to adopt the minor child of the other spouse.

(2) When separated from his / her spouse, for at least two (2) months prior to the filing of the petition, in which case the application shall be notified to the other spouse.

The subsequent reconciliation of the spouses shall not preclude the right of the petitioner to adopt individually, except that by agreement of both, the marriage may be adopted jointly if so decreed by the court, always considering as central axis the welfare and convenience of adopting.

(3) When by legal decree the spouse of the adopter has restricted its legal capacity, for the duration of that restriction, in which case the request must be notified to the other spouse.

The court will have discretion to resolve situations such as those provided in this section, always having as a guide for your decision the welfare and convenience of the child.


The following persons shall, in the presence of the court, consent to the adoption:

(1) The adopter or adopters.

(2) The adopted older than ten (10) years.

(3) The father or mother of the adoptee who at the time of adoption has the parental authority of the latter, as well as the father or mother who, by reason of a divorce decree, does not have parental authority over a minor child. Such consent will not be required in the following cases:
