(This bill was proposed by the minister of Science and Technology Rex Powell) This bill seek to reapeal ''F-89: Software Development Act'' (http://classic.particracy.net/viewbill.php?billid=528830) and to replace it by the original bill that was in place before bill ''NP-36: Software regulation'' (http://classic.particracy.net/viewbill.php?billid=501125) These are the regulation that where put in place by the bill ''NP-36: Software regulation'' : Article 1.1)If a company or a individual create and sell a close software, they will be held responsible for any kind of malfunction of their software. If there is any kind of bugs or malfunction in their software they have the obligation to create a patch to repair it. Article 1.2)If the close software provider is not able to create a patch he will have the obligation to refund every software that he has sold. Article 2)The close software provider have the obligation to explain to his customer in detail how does the software work and how to correctly use it. Article 3)The close software provider cannot hide anything inside the software code that is not related to the software main utility. Article 4)The close software provider cannot create any kind of software that spy his user without his consent. |

Message | Mr. Speaker, We fail to see how this is superior to the current legislation. Article one is highly restrictive and it shows an extreme lack of knowledge of how software works on the part of it's author. As a company, person or group cannot force every bug into the light and even when it comes out in production often times the bug is not worth fixing. Article two is not the manufacturer's responsibility, do all products come with instructions? Do bicycles, do pencils or do baseball bats? It is the responsibility of a prudent customer to do their research not a manufacturer or producer to coddle them. Article three and four are essentially the current law except the teeth that is to enforce the law is the justice system potentially costing taxpayers billions of lira and not preventing the events themselves. While the current legislation is a preventive measure which would prevent such an event from ever occurring which would save everyone time and money.
