RP: Constitutional Amendment - Zardic Public Safety Act

A bill to set out and establish a procedure for dealing with emergencies, to safeguard public safety and to provide an appropriate military, policing or civil authorities response to maintain law and order as well as restore peace.

Article 1. In the case of danger (military conflict, invasion - actual or imminent, general insurrection, disorder, natural disaster) affecting the Republic of Zardugal, the Chief Minister (head of government) has the right to declare a state of emergency in the whole country or in parts of it to restore peace, law and order.

Article 1.1. Once invoked, only the Chief Minister (head of government) can end the state of emergency with a proclamation to the Republic Assembly OR it can be overturned by a simple majority vote of the legislature (OOC: as per game rule 22.1.2).

Article 2. During the state of emergency, the head of government has the complete legal right to govern by proclamation. His/her proclamations shall override and suspend any law, including constitutional law. However, elections must take place as usual at the end of the specified legislative term. The President (head of state) is not required to sign off any proclamations made during a state of emergency.

Article 3. There is no restriction on the length of the declared state of emergency.

Article 4. During a declared state of emergency, the head of the government shall be temporarily named Commander-in-Chief of the military, national police chief and head of the border and custom guards and officials - although he/she can delegate responsibility for all, or a section, of these responsibilities to another named individual by proclamation.

Article 5. During a state of emergency the police or military can detain any person for reasons of public safety or dissident activity or for any activity that endangers the maintenance of law and order.
Article 5.1 Public meetings in areas affected by the state of emergency are not allowed unless specified by proclamation by the head of government.
Article 5.2 Police and military units shall have unlimited search powers in both public and private locations.

Article 6 - During a state of emergency, any political party believed to be acerbating the causes of the state of emergency, or believed to be encouraging seditious behaviour or preventing the government from carrying out its duties to safeguard the people, the nation and maintain law and order may be dissolved or have restriction imposed upon them in line with Article 9.2 of the Zardic constitution (which states: a political party shall be registered in accordance with the national laws and may be dissolved in cases of inactivity or for violations of national law). Article 7 - During a state of emergency local powers are effectively centralised - and state governors and state legislature will carry out their duties on the strict advice of the Head of Government.

Article 8 - The state of emergency shall automatically trigger a severe press censorship, to be exercised by the police, as well as increased border controls and rigorous passport inspections.

Article 9 - This bill asks for an amendment to the Constitution. It requires a two-thirds majority of the legislature to vote in favour.

Firstly may I point out that every party left of the Conservatives are not communist: we are a socialist party and govern for the people and with the clear will of the people.

Secondly, every responsible nation needs to have a strong and clearly defined plan in place for times of emergency - it is a matter of national security.

Finally, the democracy riots (OOC: see link) that we believe are being organised by pro-monarchist groups from both within and outside Zardugal demonstrates how quickly a stable nation can be undermined and illustrates why such protocols must be in place.
