The Create Copyright Protection Act Proposed in good faith by Independent People's Liberty League December 4303 === An Act To preserve the integrity of Cildanian creative works through the creation of new comprehensive protections of Cildanian Art and Technology by the establishment of a national Copyright to replace the formerly limited copy protections that have failed to ensure the protection of the nations created properties. Be it enacted by the Senate of the Republic of Cildania currently assembled. Section 1 Name This act is to be cited as the "Cildanian Creative Copyright Protection Act of 4303" Section 2 Findings 1. The constitution of the Cildanian Republic Article 2, Section 2 grants the power of lawmaking to the Senate 2. We find that the Republics protections of its citizen's intellectual properties are lacking. 3. We see the vital need for increases in intellectual property protections and assurances. Section 3 Clarification on Legislation 1. The current Culture Law code establishes limited copy protections for Technology and Arts. 2. Copyright is a form of intellectual property, applicable to the specified forms of creative works in Article 1, Number 2. 3. At the time of proposal, year 4303, 43 nations in the world have established comprehensive copyright legislation. === The Cildanian Creative Copyright Protection Act of 4303 Article 1 Section 1.The establishment of the Creative Copyright. Section 2.The Creative Copyright secures for limited Times to Authors and Inventors the exclusive Right to their respective original works of authorship including literary, dramas, musicals, movies, songs, computer software, and artistic works, such as poetry, novels, and artwork. Article 2 Section 1.The establishment of the "Creative Copyright Office" as an independent regulatory and enforcement agency. Section 2.The aforementioned Offices duties constitute the granting of the Creative Copyright to Authors and Inventors, handle copyright registration for citizens, record copyright transfers, and to preserve, protect, and defend the integrity of The Cildanian Creative Copyright Protection Act of 4303. Article 3 Section 1.The Creative Copyright Office is led by an executive board of governors consisting of nine equal Governors appointed by more than 1/2 of the Senate on the advice of the Ministry of Education and Culture. Section 2.Governors can hold two-consecutive terms or one-non-consecutive term only; Terms consisting of periods five years. Section 3.Governors can resign with the assent of the Ministry of Education and Culture. Section 4.A seat of Governor is not to remain vacant for a time exceeding that of 3 months. Section 5.Impeachment of a Governor can be called by 1/3 of the Senate; Impeachment trial is to be overseen by the Head of State and impeachment is carried with a 2/3 majority of the Senate. Article 4 Section 1.The establishment of Exclusive rights under copyright law. Section 2.The intrinsic and basic Exclusive rights of copyright holders include the following and are not to be withheld or restricted so long as the holder is granted and retains their copyright. Section 3.The right of holders to reproduce the work in copies or phonorecords. Section 4.The right of holders to prepare derivative works based upon the work. Section 5.The right of holders to distribute copies or phonorecords of the work to the public by sale or other transfer of ownership, or by rental, lease, or lending. Section 6.The right of holders to publicly perform the work, in the case of literary, musical, dramatic, and choreographic works, pantomimes, and motion pictures and other audiovisual works. Section 7.The right of holders to publicly display the work, in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work. Section 8.The right of holders to digitally transmit sound recordings by means of digital audio transmission. Article 5. Section 1.The standard length for Creative Copyright is established as 80 years after the holders confirmed and certified passing. Section 2.In special cases, the holder can request an increase in Copyright length to the Governing board of the Creative Copyright Office. The maximum increase in length is 50 years from the office. Section 3.In special cases, the holder can request an increase in Copyright length from the Cildanian Senate. The increase of length is to be requested by the holder, debated and if neccessary negotiated in Senate session. An increase requires a 1/3 majority of the Senate. |
