An Act to define software source code, and to extend intellectual property protections to the creators of source code who wish to keep their creation proprietary, or "closed source". This Act also provides legal protections to source code that the creators of which wish to keep within the public domain, or "open source". The extension of intellectual property rights to closed source code would ensure exclusive commercial and creative rights to the owner of said source code. The legal protections of open source code would bar the commercialization/privatization of software that is legally deemed part of the public domain. Source code creators are given the choice to either make their software closed source (thus protected as 'intellectual property') or open source (which would legally classify their software as part of the public domain). |

Message | Source code is an intellectual creation. As such, the creators are reserved the right to decide how their intellectual creation should be used. If an author writes a novel, or an artist creates a piece of art, they are already reserved the right to make the decisions on how their creation is operated and used. Source code for software is no different. Creators, inventors, authors, and artists have a fundamental right of ownership over their creation. Taking away this right is counterproductive and callously unfair to the creators, who spent time and effort to make their creation a reality. It is already illegal, under patent and copyright law, for others to modify or use without credit the intellectual property of another. Source code, being unique creations of software in itself, matches the definition of intellectual property, thus deserves the protections and guarantees of intellectual property. This Act will not force all software to be closed source. It will simply define the legal constructs of how source code fits in with already existing practices concerning intellectual property. |
