Title 1: Supreme courts in the states Article 1: Establishment 1. a Supreme court is hereby established in every state to resolve legal controversies at the state level. 2. The supreme courts established under this title shall be named in the form "Supreme court of xx" wherein the state's name is "xx" 3. The state supreme courts are the last venue of appeal for issues arising from state laws. Article 2: Procedures 1. The party claiming a violation of state law will make a motion outlining its case, the defendant (alleged violator of law), and the reparation it seeks. 2. The Defending party or institution shall have the chance to defend itself and the state supreme court will render a verdict 3. after a verdict is reached a sentence will be agreed upon by the court and enforced, this is the last venue for appeal in state law controversies. 4. rendering of a verdict and decision on a sentence shall require a majority of the justices (3) Article 3: Composition 1. the courts shall each have 5 justices, including the chief justice 2. the term shall be 15 years for each justice 3. Governor shall nominate the Justices and they shall be confirmed with a majority of the state legislature, as long as that majority composes more than one party. 4. Upon Establishment of the Courts the State Supreme Court Justices shall be given as equally as possible (OOC: one to each party, biggest parties first by state election %) 5. A Public list of the justices of the court shall be maintained by the Governor on the "X State Business Thread" and updated as necessary with information of which party controls which justices and the term beginning and ending months and years. 6. The governor shall chose one of the five justices to be Chief justice, subject to confirmation by the legislature Title 2: State Trial courts Article 1: Establishment 1. a Trial court is hereby established in every state to be the first venue for legal controversies at the state level. 2. The trial courts established under this title shall be named in the form "Trial court of xx" wherein the state's name is "xx" 3. The state trial courts are the first venue for issues arising from state laws. Article 2: Procedures 1. The party claiming a violation of state law will make a motion outlining its case, the defendant (alleged violator of law), and the reparation it seeks. 2. The Defending party or institution shall have the chance to defend itself and the state supreme court will render a verdict 3. after a verdict is reached a sentence will be agreed upon by the court and enforced, but at this time the defeated has a right to appeal to the State Supreme court. 4. If a defendant is acquitted of a criminal charge at the trial court level, the plaintiff may not appeal to higher courts. Article 3: Composition 1. the court shall have one member from each party with seats in the said state. 2. the term shall be 10 years for each justice 3. Each party will declare their judge and the Governor will track this on the "State Business Thread" along with the party that controls the judge and their beginning and ending dates for tenure. |
