Bill: Lex Oppidia de Capitis Poena
Details
Submitted by[?]: Factio Republicana Socialistica
Status[?]: passed
Votes: This bill proposes the withdrawal from a treaty. It will require half of the legislature to vote in favor[?]. This bill will not pass any sooner than the deadline.
Voting deadline: May 4373
Description[?]:
Oppidian Law on Capital Punishment Senators, Our justice system is broken. Crimes are either not punished sufficiently or not at all, and several of the most egregious crimes receive only the most underwhelming of punishments. We do not believe this to be just. Some crimes should receive no lesser punishment than death, as the most unrepentant and violent criminals willingly proclaim themselves unworthy of life. Instead of spending taxpayer money on keeping these vile individuals alive, they must be cut out from our midst to face their Creator and answer to their crimes. The Republican Party shall introduce the death penalty for the worst crimes imaginable, terrorism, treason, and crimes against mankind, and will remove the unjust treaty restrictions on the Republic's ability to carry out her own justice. Postumus Oppidius Hortensius Senator |

Message | Senators, I can't believe that we have to discuss the implementation of death penalty in our legal system, and I am truly dissapointed with the result. Apart from that, the act of trying to remove Selucia from the Treaty of the Objetives of the Century already gives and idea that this will continue into more radical laws, that will degrade even more the status of our nation into a barbaric one. Talking about death penalty: Sooner or later, innocent people will get killed, because of mistakes or flaws in the justice system. Witnesses, (where they are part of the process), prosecutors and jurors can all make mistakes. When this is coupled with flaws in the system it is inevitable that innocent people will be convicted of crimes. Where capital punishment is used such mistakes cannot be put right. The death penalty legitimizes an irreversible act of violence by the state and will inevitably claim innocent victims. As long as human justice remains fallible, the risk of executing the innocent can never be eliminated. Plus, to take a life when a life has been lost is revenge, it is not justice. Capital punishment may brutalise society in a different and even more fundamental way, one that has implications for the state's relationship with all citizens. Civilised societies shall not tolerate torture, even if it can be shown that torture may deter, or produce other good effects, it is inappropriate for a modern civilised society to respond to even the most dreadful crimes. Capital punishment is still a media circus, receiving great publicity, so that the public are well aware of what is being done on their behalf. |

Message | Senators, The death penalty is not practical. The death penalty is just. Some people make themselves unworthy of life and deserving of death through their own actions. A civilized society is a just society, and a just society punishes transgressions. If we fear flaws in the justice system the appropriate response is a better justice system, not less justice. Death is indeed irreversible, but so are decades spent in prison. That does not stop us from providing appropriate prison sentences, even at the risk of punishing the innocent. We are not calling for revenge, we are calling for justice. It is not only murderers that make themselves unworthy of life, but torturers, rapists, terrorists, and traitors must all receive their just punishment, which for many is death. Such people brutalize society far more than a suitable punishment applied under the rule of law ever can. Postumus Oppidius Hortensius Senator |
