Description[?]:
This act seeks to support both men and women in being more responsible when engaging in sexual relations. It also supports women who may have suffered from rape or economic inability to raise children. There will also be a caveat for the provision of abortion funding. 1. Women and their partners (if applicable) must go through a 2-week psychoanalysis and therapy course before agreeing to the abortion. This is to make sure the couple/individual isn't rushing their/her decision and assessing whether or not they/she is in the stable mindset to make such a decision. 2. In the case of extreme cases, such as rape, the woman will be entitled to full funding without hindrance or investigation as the clinics will be responsible for checking this information with the local police departments. 3. The same rule will apply to medical problems, the clinic will assess the health impact and make a decision after monitoring and DNA testing whether or not the termination is on medical grounds. If so, the abortion will be fully funded by the state. 4. The decision must be made by the parents or the woman who is bearing the child if a father is not identified. Doctors must ensure that fathers and mothers both have equal say in the decision and in the case of disagreement, extend the access to couples therapy and counselling in order to resolve the issue. 5. If there is no agreed status between the parents within 8 weeks of pregnancy, the final say will be given to the mother (female), as under the law the female has a right to reject a pregnancy after this time period if the father is against her decision. 6. The father has the right to appeal in a courtroom if he has grounds for his partner either being; (a) Mentally unwell or unstable (b) Physically, economically and socially able to raise a child The judge will be provided data from; the medical professionals, the mothers own testimony and the fathers counter-argument. The judge will have to identify strong evidence for the abortion rights to be removed in every case, whilst taking into consideration the physical, mental and economic well-being of the mother and father, but will also take into account other personal issues such as the use of the freely provided contraceptives. The judge will by law have to weight the arguments in favour of the mother as the mother will have to bear the child and give birth against her will if the judgement is against her. 7. If the woman is denied her rights under the courts and this has a negative impact on her relationship, which leaves her less emotionally, mentally or economically supported, then the social workers involved will have grounds to inform the courts of the situation which could change the ruling. |
