Mutanabbian Law on the Death Penalty

Senators,

The current compromise on capital punishment is ultimately untenable and manages to be unsatisfactory to all parties. Abolitionists are displeased that the death penalty can be applied on any part of the Republic's territory while capital punishment advocates believe that it is unfair to the victims that whether the offender is sentenced to death is determined on a mere geographic basis. It is time to move beyond the present compromise and implement a uniform policy on capital punishment for the entire Republic, by targeting those that genuinely deserve to die, that is tyrants and those seeking to violently overthrow our democracy.

With the passing of this bill capital punishment shall be applied exclusively for crimes against the security of the Republic, including high treason, terrorism, espionage, insurrection, mutiny, desertion, or crimes against humanity, including war crimes, genocide, ethnic cleansing, apartheid, enslavement, extrajudicial punishments, state terrorism, racial discrimination, military use of children, unethical human experimentation, and deportation or forcible transfer of population. High treason is defined as participating in a war against the Republic, aiming to overthrow the government of the Republic, spying on the Armed Forces, secret services, or diplomats of the Republic in the service of a hostile and foreign power, and killing or attempting to kill the Head of State or Head of Government. In compliance with the Supreme Court decision, all death sentences shall be automatically appealed to a second independent court, which following the same legal procedures must conduct its own investigation and convict or acquit the defendant. Should the second court acquit the defendant, a third independent jury will issue its final decision. The second and third court will have the right to issue an execution warrant should the defendant be found guilty and sentenced to death. The execution date shall not be less than 70 days nor more than 100 days from the time the execution warrant is issued. The sentence shall be carried out by a selected firing squad formed of military personnel, whose identity shall be kept secret. A random number of the members of the firing squad shall be issued weapons containing a blank cartridge, and no member of the firing squad shall be told beforehand if they are using live ammunition. No member of a firing squad can be prosecuted for murder and/or homicide for legally carrying out the death penalty. Additionally, all executions shall be televised and the media shall be given access to all executions. Steps shall be taken however to protect the identity and privacy of all members of the firing squads.

The government seems like it was too soft when we allowed death penalty to survive in some regions despite our strong opposition to it. It doesn't make sense that to support this bill and the complete legalization of the death penalty in national soil, Hon. al-Mutanabbi talks in the name of abolitionists and think that this will please them more than the current legislation, with death penalty already banned in Marestella, Oriensos and Insularia. Current legislation also grants death penalty for those cases, so there is no argument to sustain that proposal.

We will not even discuss the issue of broadcasting executions, this proposal being a totally indecent thing that goes beyond those condemned to death, affecting and stigmatizing their friends and family.

The Government will study to completely ban death penalty after this proposal.

Tyrants deserve to die. It is in our anthem. And they deserve to die publicly, for all to see that despotism does not pay, that aiming to destroy liberty comes with the highest cost, death. If Caesar Zografos believes tyrants deserve mercy, then he should propose changing our national anthem.
