Pompilian Law on Drugs

Senators,

Our drug policy is rightfully based on the idea that the use of recreational drugs, whether "soft" or "hard", harms public health and impairs our citizens' ability to participate in collective self-government. However, in our view the main role of laws is not to punish, but to establish and strengthen civic bonds. As such we find that the current policy of incarcerating all drug users, irrespective of the amount, does not support our goal of enhancing Republican freedom. Incarceration has long-term negative social consequences that make the use of punishment as a tool of social control questionable from a Republican understanding.

For this reason we propose to amend our drug policy by moving towards a harm-reduction approach towards drug regulation. Under this law use or possession of any drug shall remain illegal. However, should the amount of the illegal substance be less than a ten-day supply of that substance, the offence shall no longer be a criminal offence, but an administrative one. Offenders will be aggressively targeted with therapy or community service rather than fines or imprisonment, while criminal penalties shall remain in place for drug growers, dealers, and traffickers. Additionally the Ministry of Health shall be authorized to establish a needle exchange program, whereby drug users can exchange used syringes at any pharmacy counter for a kit containing clean needles and syringes and motivational messages regarding the harms of drug use.
