Tiburtian Law on the Consulship

Senators,

Given that, formally and in practice, the Consul Populi and the Caesar exercise equal powers and have equal responsibilities, it is necessary to modify their titles and regulate their powers in order to emphasize the collegial nature of the office and remove monarchist influences from the title. With the passing of this bill the office of the Consulship shall be governed under the following rules:

I. The supreme executive and directorial authority of the Republic shall belong to the Consuls;

II. The Consuls shall constitute a two-member executive council that shall serve as the collective executive head of government and state of the Republic;

III. The Consuls shall perform the executive functions of the Republic in the name of the People;

IV. The Consuls shall enjoy reciprocal right of veto;

V. The Consuls shall be responsible for carrying into effect laws passed by the Senate, shall jointly chair the Government of the Republic, shall have the power of issuing executive orders, and shall head the Republic's diplomatic corps, including the right to send and receive ambassadors;

VI. The Consuls shall provide, according to the laws, for the external and internal security of the Republic;

VII. The Consuls shall jointly serve as the Commanders-in-Chief of the Armed Forces;

VIII. One Consul shall be elected by universal suffrage by all adult citizens of the Republic;

IX. One Consul shall be elected by the Senate;

X. If necessary to distinguish the two offices, the Consul elected by universal suffrage shall be identified as Consul Prior and the Consul elected by the Senate shall be identified as Consul Posterior, with the former enjoying symbolic priority, including the right to be named first in the list of Consuls; in all other respects the authority of the two Consuls shall be equal;

XI. The Consuls shall be entitled to a ceremonial guard formed of twelve lictors each; the lictors shall have the right to carry the fasces;

XII. The Consuls have the right to be addressed with the honorific title of Excellency;

XIII. When issuing statements on behalf of the Republic a Consul must obtain the other's consent beforehand.

OOC: This is a constitutional RP Law, as governed by Section 6.e. of the Game Rules (http://forum.particracy.net/viewtopic.php?f=5&t=8088). This bill modifies the names of the Head of State and Head of Government, naming them both as "Consul", and establishes the two Consuls as the joint Heads of State and Heads of Government of Selucia, with equal rights and responsibilities but a different method of selection. This bill requires a 2/3 majority to pass and a simple majority to be repealed.

MessageOOC: Caesares will probably almost every time be elected far later than Consuls, as negotiations between parties can last for "years" so point XIII sounds a bit strange for me.

I would add a point to say that one Consul in their own can't speak in the name of the whole nation in official announcements, thus requiring a consensus of both Consuls to do it

MessageOOC: Well they would both lead the Council of Ministers. So instead of the "Sigilis Government" you'd have the "Arusa-Sigilis Government". In practice I think it would work a bit like the Swiss Federal Council, with executive decisions taken more by consensus. So in practice the two Consuls would just need to work together most of the time. If one does take an unilateral action then the other has the option of saying "no" and cancelling that action.

MessageAny legislature applied under this method will be full of ungovernability, because at the moment in which the two elected Consuls belong to different political parties, they will try to put the trip against each other. How does Factio Republicana intend to prevent this?

Quite the contrary. In cases when the two Consuls belong to different parties, Selucia will effectively become a Parliamentary democracy as the main policy-setting body will become the Senate, where new policies can be implemented by avoiding the conflicts within the executive. When the Consuls belong to the same party then Selucia will be a Presidential democracy, as the dual executive will dominate policy as it will be backed by a Senatorial majority. Cohabitation will effectively force the two Consuls to work together and will constitute an additional layer of checks and balances within the executive. Given that the main responsibilities of the Consuls are in the fields of foreign and military policy, whether the executive is divided or not, the end result will be that the Republic will present a single coherent foreign policy while permitting internal political conflict.
