HONOURABLE MEMBERS OF THE ASSEMBLEIA NACIONAL, CONCERNED with the appalling infringements on basic human rights and to the dismissal of any principles of due process and judicial fairness; NOTING our police forces are vastly unregulated and unsupervised, despite them bearing legal grounds to kill, torture, and suppress the rights to life, privacy, and property of our citizens; AIMING to humanise the State's legitimate use of force in law enforcement, seeking to protect our law-abiding population from sheer abuse, whilst still ensuring the armed forces have enough autonomy to perform vital safety-keeping operations; STEERING Tukarali towards a path of more comprehensive civil liberties and human rights; THE PST PROPOSES THE FOLLOWING ARTICLES, with considerations: 1) Tukarali is the only country in our planet that does not operate or funds any sort of police force, leaving law enforcement in the hands of organised crimes and unregulated militias. Recognising our country's federalist tradition and following the majority of our foreign neighbours, it is vital the State takes on the responsibility over a national police force and further instructs local police departments to fund personalised police forces, more adequate to their particular needs. Thus, we introduce a change on the principle of ORGANISATION OF THE POLICE. 2) Noting again how outdated and against-the-current our police policies are, we must move to establish clear limits to the police's actions and regulate its legitimate power. Thus, in accordance to the international consensus on the matter, we move to establish a new POLICY ON THE POWERS OF THE POLICE. 3) Aiming to reduce a militarist overtake of our law enforcement, also discerning heavy weaponry does not make for better policing and may increase the death toll of innocents, we propose a change in the laws regarding the WEAPONS USED BY POLICE FORCES. 4) Our police forces have unrestricted powers to infringe on our population's privacy and property, a severe blow on our nation's democratic and egalitarian foundation. In order to assure the oversight of the judicial system and our courts over police activity, thus ensuring the State acts to defend innocent citizens from blatant discrimination and abuse, we aim to introduce warrants and the principle of imminent danger to regulate POLICE SEARCHES. 5) Once again, we are one of the most backwater and abusive countries in the world regarding civil-judicial rights. Not only do we enforce primitive law enforcement and justice approaches (which will also be addressed in further bills), but we actively dismiss any concern or state responsibility over the protection of basic human rights. Namely, the use of torture by police officials and the unrestricted use of the death penalty are major constitutional problems. We propose changes to the USE OF TORTURE and DEATH PENALTY. * Regarding capital punishment, we are vehemently against it. However, in the name of compromise and opting for a gradative transition, we will first propose its regulation and then its abolition. |
