This bill will not proceed to voting until 4479 or if a consensus is reached. =================== 1. PREAMBLE =================== Allowing the proliferation of hate speech permits the normalization of extremist views, furthering the divide among people in society. Hate when left unchecked can lead to violence and a possible collapse of the democratic order. Hate speech must therefore be restricted in order to maintain harmony, inclusion, and respect among social groups. =================== 2. LEGISLATION =================== 1. Hate speech is defined as expression that attacks people based on their gender identity, family lineage, sexual orientation, religion, nationality, disability, race, ethnicity, age, or sex. This definition shall also include genocide denial. 2. Factual statements, including those based on statistics or scientific evidence, shall not be considered hate speech when communicated in the public interest and not to seed division. 3. There shall be no criminal penalties for hate speech expressed privately, such as those communicated in the home. This exemption does not include messages sent via telecommunications or other information delivery services that are used for harassment. Criminal prosecutions should focus on expression published in the public media. 4. The penalties of hate speech shall be limited to fines not exceeding $10,000 INS and prison sentences no more than two years. Other penalties may include bans on media publications guilty of two or more hate speech offenses. These bans may also extend to individuals. Such bans may not exceed 5 years in duration. The Grand Assembly is permitted to enact further restrictions after a successful conviction at the discretion of a 2/3 majority in extreme cases. The Grand Assembly may also enact restrictions, including travel bans or deportations, on non-citizens with a 2/3 majority vote in the event hate speech is used abroad or domestically. 5. At the discretion of the courts, hate speech offenses may be pardoned if the offender demonstrates genuine regret, is willing to perform community service to make amends, and has expressed no intention to re-offend. |
