Bill: Inquisitorial Judicial System Adoption Bill

Details

Submitted by[?]: Sunrise Party 해돋이당

Status[?]: passed

Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: January 4515

Description[?]:

We are considering whether we should formally establish Inquisitorial system in full as we effectively practice it anyway, though our current legal codes specify a right to Jury Trial(which is typically a feature of adversarial system.

The key difference is Inquisitorial system a neutral Judge is appointed to investigate and deliver a verdict on a case, in Adversarial system, the Judge is passive referee and Jury delivers a verdict(OOC: there are different types of Juries though such as Grand Jury see this article for reference https://criminal.findlaw.com/criminal-law-basics/difference-between-grand-jury-and-trial-jury.html ).

MessageDear Speaker,

This bill goes against our party beliefs. People should have a right to trial by jury and we should not choose jurors as if we do, it will look very bias

MessageEsteemed Minister,

Your comments are noted, yet we haven't really been practicing juror system, rather appointing a neutral investigator and said investigator rendering a judgement in cases of late, which more matches the Inquisitorial system. Simply making what we actually do the established the law of the land. Regarding Trial by Jury, it still allowed by the current bill, but it would be certain circumstances(we'd be more than happy to see your party write up regulations regarding circumstances when it is not to be applied).

We support Appointing them for rationale that jurors should be competent in these matters(too often a demagogue could sway a Jury to their side, even if facts state the person is guilty of crime). There are disadvantages to the Adversarial system(not to mention one party is assumed guilty while the other is innocent when it could be fact that both parties are at fault or innocent). We don't believe in straight up abolishing Juries completely, but we do support increased standards in how jurors are selected and in which cases should be jury defined. Truth isn't necessarily a Democratic principle(which is embodied in Jury system), it's a independent function from it, and Juries don't necessarily serve justice but may in fact serve popular biases at the particular time of the case(evidenced by Jury Nullification). Such needs to be guarded against in an effort that right decisions are made.
