Mummian Law on the Senate A law to restore the authority and dignity of the ancient Senate. When our forefathers renounced kings and princes, they chose from among themselves the wisest and most virtuous elders and established a Senate, embodying the auctoritas patrum, the moral authority of the elders. Over time the original meaning and jurisdiction of the Senate has changed significantly, so much so that, rather than being an assembly of the best Selucians, it has become a democratically-elected legislative assembly. In line with the ancients (OOC: Cicero), we believe that "Cum potestas in populo auctoritas in senatu sit." ("While power resides in the people, authority rests with the Senate.") It is thus time to reinstate the Senate to its ancient splendor, and to restore the ancient office of Censor, empowered to select and remove Senators. Article I. The Head of State of Selucia shall be the Senate. Article II. The Senate shall be formed of no less than 100 members. There is no upper limit on the number of Senators. Article III. Senators serve for life. Nobody can refuse appointment to the Senate. Article IV. Senators shall be appointed by the Censor. The Censor can raise whomever he or she wishes to the Senatorial dignity, provided they are Selucian citizens of the age of majority. The Censor may also remove whomever he or she wishes from the Senate, with the exception of automatic office holders as defined in Article V. Article V. Holders of the following offices are automatically appointed to the Senate: all executive magistrates from Quaestors upwards, the Pontifex Maximus, and the Flamen Solaris. Article VI. The Law on the Rector of the Republic (http://classic.particracy.net/viewbill.php?billid=585440) is repealed. Article VII. The Senate shall act as the Head of State of Selucia and shall embody the Republic and represent its authority. Article VIII. The powers of the Senate include: a. the right to represent the nation, guarantee its independence and see to it that the Constitution is observed; b. the right to direct foreign policy, and to represent the Republic abroad, in which case a delegation of ten Senators shall be sent; c. settling disputes that may arise between the central and provincial and municipal governments; d. passing "senatus consulta" (s.g. senatus consultum), texts of advice sent to a magistrate of the Republic; senatus consulta do not carry force of law unless they are presented to the legislative by a Consul or a Praetor (http://classic.particracy.net/viewbill.php?billid=630033) and approved by the People's Assembly (http://classic.particracy.net/viewbill.php?billid=630034). e. initiating a state of emergency by passing a senatus consultum ultimum. Article IX. The Senate shall meet for regular meetings on the Kalends, Nones, and Ides of each month (http://classic.particracy.net/viewbill.php?billid=629692), and can be convoked for extraordinary meetings at other times if summoned by a magistrate. Article X. When convening for a regular meeting the Senate shall be chaired by one of the Consuls. When convening for an extraordinary meeting the Senate shall be presided by the convening magistrate. Article XI. The Senate can be convened by a Censor, a Consul, a Praetor, a Quaestor, or a Tribune (http://classic.particracy.net/viewbill.php?billid=630037). Article XII. No decision can be passed by the Senate unless a quorum of 100 Senators is met. The Senate shall take its decisions by majority vote. Article XIII. The Censor shall be elected once every five years by universal suffrage and shall be the highest executive magistrate in the Republic. The Censor shall not however possess imperium, i.e. the ability to command armed forces. Article XIV. The Censor's powers include: a. appointing and removing individuals from the Senate; b. overseeing the private and public morals of Selucian citizens and ensuring the preservation of Selucian virtues; c. supervising the lustrum, which shall be performed once every five years after the Censorial election, or after any new Censorial election. https://en.wikipedia.org/wiki/Lustrum Article XV. Censors cannot be impeached or otherwise removed from office. Should a Censor become incapacitated during their time in office, the office shall remain vacant for the remainder of their term. Article XVI. As the highest ranking executive magistrate, the actions of a Censor cannot be repealed by any other executive magistrate or by the legislative. This bill establishes the "Senate" as the collective Head of State of Selucia. The Senate is nominated by the Censor, who is elected as the head of state through the regular in game system. The person that controls the Censor will have the right to RP the Senate as collective body, given the power of the Censor to nominate and remove persons from the Senate. Any player in Selucia can RP individual characters belonging to the Senate. |
