Article 1. Fundamental rights and freedoms: Whereas every person in the Union and Republic is entitled to the fundamental rights and freedoms, that being, the right, whatever his or her race, place of origin, birth, political opinions, colour, creed or sex, but subject to respect for the rights and freedoms of others and for the public interest, which was fought for in the Revolution, to each and all of the following, namely: • Right to Equality • Freedom from Discrimination • Right to Life, Liberty, Personal Security • Freedom from Slavery • Freedom from Torture and Degrading Treatment • Right to Recognition as a Person before the Law • Right to Equality before the Law • Right to Remedy by Competent Tribunal • Right to Fair Public Hearing • Right to be Considered Innocent until Proven Guilty • Freedom from Interference with Privacy, Family, Home and Correspondence • Right to Free Movement in and out of the Country • Right to Union Nationality • Right to Marriage and Family • Right to Own Property • Freedom of Belief and Religion • Freedom of Opinion and Information • Right of Peaceful Assembly and Association • Right to Participate in Government and in Free Elections • Right to Desirable Work and to Join Trade Unions • Right to Rest and Leisure • Right to Adequate Living Standard • Right to Education Article 2. Protection of Fundamental rights and freedoms: No recognized citizen of the Union and Republic and her subordinate structures and states shall be denied the freedom to exercise the rights and freedoms as established underneath Chapter II: Article 1. For a violation of these rights by any government, organisation or individual shall be viewed as a direct violation of the supremacy of the Constitution (with the exception of certain cases as pointed out in Chapter V: Article 4, or those who have been Constitutionally Protected as described in Chapter VI: Article 2, Section 2). OOC: This is an RP Constitutional Law. To be approved it needs 2/3 of the houses' votes in favor. It can be abolished only by a simple but absolute majority. |
