In light of the fact that the current law appears to grant the police too much power in dispersing large gatherings of protest crowds, regardless of the situation, the PEL feels it is appropriate to introduce a resolution to allow the police to exercise their powers within the spirit of the law, whilst granting the people the freedom to gather without having to worry about random police intervention.

No group of people, no matter how large; whether a protest rally crowd or a crowd gathered for a music festival, shall ever be broken up. The police cannot disperse a group without beyond a doubt belief that there is wrongdoing transpiring.

They may only break up a group when there is a significant threat to public safety.

If the crowd gets too rowdy and is burning flags and/or setting fires, showing early signs of riot-fever, or general disregard for the spirit of law (such as: throwing rocks and other material and debris at police cars and/or on duty peace officers, who may be present at the request of the city to ensure that no one is hurt).

If the people gathered are expressing opinions and leading a protest against government policy or other issues at hand, they will be permitted to go about it freely. They will not be dispersed until the protest shows imminent signs of turning sour.

Protests and expressions based on hatred, and the transmission of messages containing racist, discriminatory, sexist or other offensive messages will not be tolerated. These will be broken up.

However, the above is a slippery slope and they cannot be automatically broken up if they are merely protesting against practices or policy.

MessageThank you. We thought it was needed after a recent trend of parties wanting to loosen the current law. There needs to be a sensible mix of law and freedom in order for people to be truly safe. Too much regulation is dictatorial and too much freedom is anarchy.
