Description[?]:
The HPP see a neccesity in allowing the courts to force individuals to give information or release hidden objects, that can be used to settle guilt or to clear out cases where the courts could use such information. Why should a fair trial be undermined by a deficit in our legislation. We must se to that in certain cases it is neccesary to require information. therefore we suggest that in cases where the courts have decided to, information must be given or evidence must be handed out. We would like to introduce Habeas Data. We would like to add this ammendment to the proposal: "The identity of the person(s) from whom this information has been obtained should not be released without their consent." |

Old value:: Individuals have a right to privacy, to keep records and information for themselves.
Current: Individuals have a right to privacy, but the courts can force individuals to give information on certain matters if needed. (also known as Habeas Data).

Message | Again, we find ourselves in agreement with the HPP. Innocent people must not be blamed for crimes if the information of their innocence is available and only not submitted because someone does not wish to release it. It is one of the few times when a person should be forced to release data. However, as with the previous bill, we would like added to the bill that the person from whom this information has been obtained identity should not be released without their consent. |
