The powers and uses of eminent domain are left to the state governments, that they may determine what their comunity needs and what measures are appropriate to achieve those goals. In order to prevent abuse of this power victims of eminent domain are allowed to set the compensation amount, with the government left with the burden of appealing to the courts.
