Everyone should be able to agree that every person should be allowed to choose to be an organ donor upon death.

Everyone should additionally be able to agree that every person should be allowed to choose not to be an organ donor upon death.

However, there remains the question of the person who has not expressed his or her desire in either direction.

With organ donation being better for society, and really irrational to refuse (one cannot use organs after one is dead), we strongly prefer that if no desire has been expressed in either direction, the person shall be presumed as willing to donate, rather than the current law in which the default presumption is that the person is unwilling.

We must note very clearly that in no way would this take away a person's right to refuse to donate organs. The only change is that the presumption is that they allow it, if no choice has been expressed.

(OOC: This measure always seems to have trouble, when I think it's by far the sanest alternative, because of the wording of the measure. "...allowed with personal consent" sounds better than "...consent is assumed." It should read more neutrally, saying in both cases "...allowed with personal consent" followed by "unless otherwise stated, consent is assumed" (or "unless otherwise stated, lack of consent is assumed", in the case of current law).
