The Organization of Drug Exporting Nations (ODEN) III

Preamble: This Treaty offers an updated and expanded version of the ODEN Treaty. ODEN III aims at guaranteeing state involvement in the Drug Industry. This Treaty will contain international provisions, as well as Kalistan-specific provisions. The Organization of Drug Exporting Nations ("International ODEN"), headquartered in Kaliburg, Ananto, Kalistan, is a coalition of states dedicated to the purpose of promoting the good and proper manufacturing, exporting and selling of drugs across the nations of Terra. The consistent purpose of all meetings of the ODEN, both the International and each subsidiary branch, is to scrutinize and evaluate the policy on drugs of nations across Terra and the economic, societal and political impact of these policies. ARTICLE I- International Provisions Clause 1 Whilst ODEN is ratified the following shall be carried out as a matter of government policy: a) All Signatory States will, upon ratification of the Treaty, open a Subsidiary Branch of ODEN within their state. Signatory States shall be responsible to name a Subsidiary Director of ODEN within their nation, and the subsidiary branch will be named "ODEN-(common name of the signatory State)" b) Within Signatory States, there should be minimal taxing and regulation of drugs, pharmacological chemicals, mind and physiology altering substances, intoxicants, including alcohol, tobacco, marijuana, other naturally occurring substances, and other chemlab manufactured substances [herein referred to simply as drugs] plus all paraphernalia needed to properly use these drugs and chemicals, to include hypodermic needles, rolling papers, and other smoking materials in order that trade of these materials should be free and open. c) In accord with the Governments of all Signatory States, ODEN Subsidiary Branches will perform the regulatory function of all signatory nations' national drug production to ensure that the highest quality drugs and paraphernalia are maintained and available for trade both domestically and internationally. Only the highest quality products, which receive the official ODEN seal, may be sold internationally. International ODEN will work with signatory states to develop quality standards. d) All subsidiary branches of ODEN will periodically inventory their national productive capability and will place the summary of the audit in the ODEN Forum: http://forum.particracy.net/viewtopic.php?f=14&t=6422 e) All signatory States will work diligently with their subsidiary branches of ODEN to bring an end to prohibition of drugs across Terra f) Signatory States will work with their Subsidiary branches of ODEN to establish an annual conference in which representatives of all parties from all Signatory nations can discuss the actions and policies of the ODEN g) Signatory States will cooperate to develop a single selling price for all ODEN exports. This price is designed to guarantee each signatory State a fair share of all profits from international sales of ODEN drugs and to prevent destructive trade wars. Clause 2 a) International ODEN shall establish a committee whose role is to ensure that all Signatory States follow the international provisions and policy prescriptions established in this treaty. b) Furthermore, International ODEN shall seek to encourage non-member nations to also comply and to then ratify this treaty too. ARTICLE II- Kalistan-Specific Provisions Clause 1- Organization of ODEN-Kalistan a) ODEN-Kalistan will be Headquartered in Kaliburg, Ananto, Kalistan b) The Government of Kalistan will establish ODEN-Kalistan as an independent subsidiary Branch of ODEN. The Government of Kalistan shall exercise only advisory authority over ODEN activities and policies. c) The President of the Republic will name all Directors of ODEN-Kalistan. ODEN-Kalistan and the National Assembly of Kalistan will work in tandem to ensure complete freedom of use and distribution of all drugs, and the setting of national drug policy in Kalistan d) ODEN-Kalistan will be completely subsidized by the Socialist Party of Kalistan, but shall be independent from the Party. The Socialist Party of Kalistan shall retain no official authority over the activities of ODEN-Kalistan. Informal discussion and consultation is expressly permitted between the two entities, as requested. e) ODEN-Kalistan will be permitted to create its own subsidiary branches in each District, as needed. The Director of ODEN-Kalistan shall name directors of District subsidiaries. Clause 2- Function of ODEN-Kalistan a) ODEN-Kalistan will work with drug producers to ensure that all drugs manufactured within Kalistan are of the highest quality. ODEN-Kalistan may offer advice and technical assistence in research and development of new or higher quality varieties of drugs in Kalistan. b) ODEN-Kalistan will act as a clearinghouse for drugs and paraphernalia within Kalistan. While drug producers may sell their products within Kalistan independently, ODEN-Kalistan will strive to provide the best price point for producers, as well as a guaranteed buyer of drugs that allows for stability in markets and regularity in purchases. All drugs produced by the National Agricultural Administration or the National Service Program on nationalized farms will be sold exclusively to ODEN-Kalistan c) ODEN-Kalistan will only purchase the best quality drugs and paraphernalia in each category of drug. ODEN-Kalistan will only certify a product with the ODEN seal if it meets certain high standards as set by ODEN-Kalistan's quality control board. For raw drugs, ODEN-Kalistan may only issue a certification if purity is independently measured at 98% or higher. d) ODEN-Kalistan retains exclusive discretion with regard to pricing of all drugs it sells within Kalistan, but prices may never be more than "at-cost". e) ODEN-Kalistan will possess a monopoly on drug exports from Kalistan. No Drug maker or distributor will sell drugs manufactured or assembled in Kalistan abroad. The penalty for sales of contraband will be immediate seizure of all products, precursors and processes, as well as a ban from producing drugs within Kalistan for 25 years. f) ODEN-Kalistan will export with the aim of "dumping" Kalistani drugs on world markets, and will explicitly ignore international norms of free trade, except where explicitly forbidden to do so by Treaty to which Kalistan is a Party. ODEN-Kalistan will ignore local drug prohibition where it exists, except where explicitly forbidden to do so by Treaty to which Kalistan is a Party. g) ODEN-Kalistan will provide all chemical formulas and processes for all pharmaceuticals and therapeutic, and recreational drugs developed or utilized in Kalistan to the world, for free. h) ODEN-Kalistan will act as a seed/spore bank for all producers, without regard to nationality. All producers looking to begin growing natural, and naturally derived drugs and pharmacology will need to fly to Kalistan to get starter kits and instructions on growing whatever they are interested in growing. i) ODEN-Kalistan will lobby the Government for complete and unhindered access to and use of all drugs, intoxicants and pharmaceuticals, and the elimination of restrictions on manufacture and distribution, including lack of subsidies for Kalistani citizens. ARTICLE III- Enactment This treaty will go into force in any Signatory State upon passage of a ratification act through the National Legislature. At this time, the signatory state shall be considered a full Member of ODEN, and will be given all technical assistance and financial support by International ODEN to set up a subsidiary branch of ODEN. ARTICLE IV- Non-Exclusion No signatory state is excluding from adopting Kalistan's model of a subsidiary Branch, and the Government of Kalistan will recognize the Signatory State's right to set up their subsidiary branch as they deem fit. Nor will subsidiary branches export ODEN products to other signatory states where ODEN exports compete in any way with domestic ODEN products. |
