Amendment to Yindala Da Tong - Jumhuriat al-Badara Trade Agreement

The Yindala Da Tong - Jumhuriat al-Badara Trade Agreement is hereby amended by adding provisions 4-6 to that agreement so that upon ratification by the parties hereto that agreement will be amended to read as follows:

1. Free Trade. The citizens and businesses corporate and otherwise organized of the two signatory nations may buy and sell each others' goods and products free of customs duties, tariffs and other taxes imposed on the basis of difference of citizenship. Further, commercial air traffic, services generally and construction services specifically are included in this agreement and covered by the terms thereof.

2. Investment. Citizens, businesses corporate or otherwise and the governments of Yingdala Da Tong and Jumhuriat al-Badara may invest in the businesses of each other whether through a stock market or other arrangement. Since foreign investment in Badaran business is limited to 49%, this agreement will authorize investment up to 49% investment in the businesses of either nation. There will be no discrimination against the owners of capital thus invested whether through regulation of stock markets, bankruptcy law or otherwise.

3. Withdrawal: Should either Yindala Da Tong or Jumhuriat al-Badara decide to withdraw from this treaty, 6 months notice shall be given by the withdrawing party. All transactions whether concerning purchases of goods or services or investing in business operations completed prior to such notice shall be considered valid and continue in effect.

4. Yindala Da Tong shall buy from Jumhuriat al-Badara 1 billion barrels of crude oil per annum. Payment shall be made when delivered, and the price shall be the market price when delivered. It is understood that the sale by Jumhuriat al-Badara may well consist of arranging for the government owned corporation Petroleum Development of Badara to furnish the crude oil constituting the subject matter of this agreement.

5. Yindala Da Tong shall buy from Jumhuriat al-Badara 4 trillion cubic feet of natural gas oil per annum. Payment shall be made when delivered, and the price shall be the market price when delivered. It is understood that the sale by Jumhuriat al-Badara may well consist of arranging for the government owned corporation Petroleum Development of Badara or Majatran Leasing Corporation to furnish the natural gas constituting the subject matter of this agreement.

6. Provisions 4 and 5 shall be treated by the parties as performed in lieu of the obligations of Jumhuriat al-Badara under the Majatran Economic Association - Yingdala Trade Agreement of April 4757.
