Although the AAP is extremely weary about eminent domain, we believe that we should fix up the act of compensation. The old system has the "victim" of such use demanding compensation and the government appeals on whether the cost is too high--but this happens at an alarming high rate when it happens. Instead we should have an independent arbitrator set compensation costs. In theory, both parties would appeal though they shouldn't, not with an arbitrator (I notice it says courts, but could both plaintiff and defendant agree on a single person to arbitrate)? |

Old value:: The victim of eminent domain sets compensation, government can appeal to the courts if they deem the cost too high.
Current: The government determines compensation for victims of eminent domain; victims can sue if they deem it unfair.
Proposed: A neutral body appointed by the courts determines the compensation, either party may appeal.
