| Pargraph 1: In case of a war, civil unrest or other special events, the parliament can declare a "special situation". 1.1 Such declarations are only allowed, if the event or processe is a danger to the state and the people of Selucia. Paragraph 2: The "special situation" can only be declared by a 2/3-majority in the parliament and must be approved by the head of state. 2.1 If it is for the parliament not possible to come together, then the head of state has the right to declare the "special situation" alone after consultations with the cabinet. 2.2 But, as soon as the it for the parliament to come together, the parliament must hold a vote on the "special situation". If more than a overall majority apporves the end of the "special situation" than it is over. This must happen by no later than 7 months. 2.3 A 2/3 aproval by the parliament is under any case needed, if Selucian troops want to fight on non-Selucian territories. This must happen regardless to any circumstance. Paragraph 3: If a special situation takes place , the minister for defence automatically becomes head of all troops and of the whole military. But he has to report everthing on the head of state. Miltary actions should happen in a consent. 3.1 The parliament of Selucia has as well the right to know everthing over the military actions. All MP's have the right to ask questions. 3.2 In an event of a special situation, all MP's will be automatically proven on collaboration with the enemy. If such a collaboration takes place, the MP will lose his mandate and will be send to prison. 3.3 In a special situation, the national government and the executive units in the administrative districts have to take shelter in special bunkers. Pargraphe 4 (War section): The use of nuclear warfare is allowed by the ministry for defence for any reasons. 4.1 A declaration of war must be approved by 2/3-majority and must be executed by the minister for foreign affairs. 4.2 In a special situation or a war, the government has the right to restrict communication, food supplies or other essential services and human rights. 4.3 If a war or a special situation was declared, the military can act in the borders of Selucia with the police and other state security agencies. 4.4 But if Selucia is attacked with or without a declaration of war, then the defence minister becomes automatically head of all troops and the special situation is automatically declared. 4.5 But the defence minister has to bring up a vote then after 7 months on the special situation and on the continuity of the war. 5. This law is a constituional ambendment. It requires a 2/3 majority to pass and to change anything there as well there is a 2/3- majoity needed. |
