| ARTICLE I. TITLE This Act shall be known as the Organ Donation Act of 3162. ARTICLE II. DECLARATION OF POLICY The State shall recognize every individual's right to life and his or her right to control his or her body. The issue of organ donations involves the submission of one's body part in order to be utilized by another individual who may have a deficient or a missing body part of the same type. Because it involves his or her body, the State shall see to it that it is the original owner of the body part who will decide on the matter pertaining to organ donations. ARTICLE III. ORGAN DONATIONS Section 1. Organ donations shall be a voluntary act done under the free will of the organ donor. Section 2. Organ donations shall be considered as legal only if the original owner of the organ/s agrees to donate it for another individual. This must be reflected through a written consent signed in the presence of the licensed doctor who is tasked to perform the operation. Section 3. Organ donations conducted without the consent of the original owner of the organ shall be deemed as illegal. Section 4. Relatives or friends shall be prohibited from providing consent for organ donations in behalf of the owner of the organs. Section 5. Organ donations shall only be limited to consenting adults. Those below the age of 18 shall not be permitted to donate their organs even if they provide personal consent. |
