As the law and society at large becomes steadily more complex, there is a greater need for lawyers, as the average person cannot possibly have a separate career and learn to be well-versed in law at the same time. Thus, our nation recognizes the need to provide lawyers in criminal actions. However, our current idea of providing lawyers only to "low income" defendants is rather arbitrary. What counts as low income? And it is also a discriminatory policy. The wealthy and middle-class lose just as much, if not more, from a jail sentence as the poor. For these reasons, we propose that free counsel be offered to all defendants in criminal trials, regardless of economic status. The cost to our nation will be fairly small, and the benefits to our due process system will be greatly enhanced, as people will be able to understand the laws they are being charged under--the first requirement of having due process. |
