Unfortunately, while Private Property is a cherished right in Rutania, millions of POOR families just cannot AFFORD to acquire vast acres of LAND or Corporate Stock, so their ONLY avenue to FULLY enjoy their Private Property Rights is by this Government guaranteeing them to the RIGHT of INTELLECTUAL property if they, fortunately, have an IDEA, paint a masterpiece, or write an exceptional novel which can be turned into a movie.

However, this bill also incorporates the "FAIR USE" Doctrine of Intellectual Property to give citizens that do not "technically" OWN the "rights" to a book or movie to USE that intellectual property.

The terms of the "FAIR USE" Doctrine are based on the following 4-part test:

(1) The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) The nature of the copyrighted work;

(3) The amount and substantiality of the portion used in relation to the copyrighted work as a whole;

(4) The effect of the use upon the potential market for or value of the copyrighted work.

(5) In summary, a citizen can be (legally) ALLOWED "Fair Use" of a copyrighted work if he/she is doing ACADEMIC RESEARCH, SATIRE, or a PARODY of the work.
