NATIONAL ASSEMBLY Registered by the President of the National Assembly, 10th of January, 3914. PROPOSED LAW to establish firmer worker rights and union powers, (Referred to the Committee on Economic Affairs, failing constitution of a special commission within the deadlines provided for in Articles 30 and 31 of the Regulations.) presented by ladies and gentlemen Léon Jacqueillez, Isabelle Durmignon, Jean-Marie Françoisie, Louise Merchons, Pierre Savres, and members of the Socialist Labor Party, petitioners. ------------------------------- EXPLANATORY STATEMENT Ladies and Gentlemen, This bill seeks to code stricter rights for workers and union members. Currently, employers are allowed to fire striking workers under certain conditions. The authors of this bill disagree with the premise that an employer should have such dictatorial control over a worker's life. Therefore, this bill proposes a prohibition on firing workers because they are striking, although firing for reasons other than striking while a given worker is on strike is allowed. Even then, in some sectors of the economy striking workers are required a minimum service, i.e., forced to work. The authors of this bill feel that this destroys the point of a strike and is uncalled for. This bill, to ensure that workers are treated fairly, also requires the establishment of democratic worker councils in the commanding heights of the economy. * The purpose of this bill is to: - forbid employers from firing their workers under the pretense of striking. - remove the minimum service requirements for striking workers - require the largest sectors of the economy to institute Democratic Worker Councils. These, ladies and gentlemen, are your reasons offered to adopt this bill. PROPOSED LAW Article I The Alternative Manifesto Act of 3900 §II--iii is amended as follows: The section reading "Employers may fire employees and/or subordinates who have gone on strike and are deemed to have gone on strike without a reasonable cause, defined as below-median working conditions in any aspect. This act may be challenged in a local court under the crime of Intentional Disemployment." is replaced with "Employees and subordinates to an employer may go on strike regardless of reason without fear of disemployment. If disemployment occurs for the strike and not for a reason outside of that, it may be challenged in a local court under the crime of Intentional Disemployment." Article II The minimum service requirements for striking workers are hereby repealed. Article III Enterprises withing the largest 56% of sectors of the economy shall be required to establish a democratic worker council, defined as an elected body of any positive percent of employees, where each employee chooses from among his peers representatives by free and fair elections counted by any positive number of randomly selected individuals from among the employees, as its main decision making body, that is, performing the majority of roles legally assigned to corporate decision making bodies. Article IV This Act shall take effect six months from the day of its passage. |
