EXTRADITION LAW ARTICLE 1 When a citizen, resident or asylum granted foreign citizen of Likatonia is claimed by the justice of another nation, then the government may start an extradition process provided that: - The claiming nation is not at war with the Federal Republic of Likatonia - The claiming nation has got effective separation of powers and justice is imparted by independent courts - Death penalty is outlawed in the claiming nation. - Cruel or inhumane treatment of suspects and convicts is not allowed in the claiming nation. - The claiming nation has not been specifically forbidden to claim extradition by the Department of State. ARTICLE 2 Extradition processes will be evaluated by the Court of Extraditions, dependent on the Department of Justice. The Court will evaluate whether the crimes the defendants are accused of are also crimes in Likatonia; whether the sentences they face are proportionate, and whether the claiming country collaborates with Likatonia in its extradition requests. ARTICLE 3 The claiming nation shall bear with the costs of the extradition and shall be responsible for the imprisonment and/or sustenance of the extradited Likatonian citizens. Once the judicial process (or the sentence, if applicable) is finished, the claiming nation shall return the Likatonian citizens to Likatonian soil. ARTICLE 4 The Federal Republic of Likatonia shall always keep the right to claim back Likatonian convicts or suspects that have been extradited to foreign nations under this law. HEREBY I sign this bill for its ratification by the Congress of the Federal Republic: ~~~~ Mark Quomo, Secretary of Justice |
