| The National Congress, reaffirming the principles and values of the Istalian civilization, aware of the need to provide the State with adequate tools to defend those principles, institutions and laws that have been organized and produced based on them, aware that an advanced and tolerant society, in order to survive, it cannot tolerate intolerance, it decrees that the Head of State must be invested with a Mandate addressed to the Defense of the Homeland, of the Institutions and of the values and principles on which they and the Istalian Society were founded. An important role of the Head of State from now on, in addition to the prerogatives already assigned to him by the Constitution and the previous Laws, will be to defend, guide and maintain the path of Istalia and its People on the path of the sacred values they have made our civilization great, values of tolerance, equality, respect and dignity for every single member of the Istalian nation and for all human beings. This mandate authorizes the Head of State to adopt all the measures necessary to counter any threat that could endanger the State, the People and its Institutions. The Head of State is authorized to act by decree in the event of an impending emergency but any action taken must be confirmed within 6 months of the National Congress. With a National Congress vote, special powers may be granted to the Head of State for a fixed period of time, which may also include the temporary suspension of constitutional guarantees, in the case of imminent and proven danger to the survival of the State. The Head of State will be responsible for the actions taken during this period before the Congress which, having approved the special powers, will have to publicly announce a national emergency and cannot be dissolved and must remain in continuous session until the end of the emergency period . A special committee of the Congress will have to be created in order to monitor the actions of the Head of State and therefore express, at the end of the specific period of granting the special powers, the legitimacy of such actions. Furthermore, to guarantee additional tools to raise public awareness and to avoid adopting the extreme ratio measures indicated above, the National Congress declares as administratively and criminally sanctionable all those manifestations and actions of intolerance and threat to the State, the Society and the Institutions, and therefore to the Values and Principles of the Istalian Nation. Among these we condemn and authorize the action of law enforcement and the judiciary for: - Incitement to violence against individuals, social, religious, ethnic and political groups, against the State and the Institutions - Discriminatory propaganda affecting individuals or social groups because of their ethnicity, their gender, their sexual orientation, their religion, their political beliefs, possible disabilities. - Formation of associative, political and / or paramilitary organizations guided by values, principles, ideologies and objectives incompatible with those of the State and the Istalian Nation. The State can recognize, after deliberation of the National Congress, on the initiative also of the Head of State, the undesirability of some individuals and/or organizations if they are considered as dangerous for the State and the Istalian Society, even if they belong to certain international organizations and / or if citizens of nations judged as dangerous and threatening to the stability and security of the Istalian State and its People. The adoption of all those measures to guarantee the security of the country is therefore authorized, with the possibility, in the case, to deny access and therefore the crossing of the Istlaian borders and / or authorize the immediate expulsion of such individuals with denial of their visas. In case of crimes sanctioned with imprisonment, foreign citizens will undergo the istalian law and will be sanctioned and detained in Istalia until the end of the sentence following which they must be returned to their nation. The Government will handle case by case all the extradition request of foreign citizens by part of their countries. In case of Istalian citizens found guilty of the crimes described, they can be sanctioned with fines or even with imprisonment. Those condemned due to the previous provisions must attend rehabilitation e reducational course during the imprisonment period in order to learn about principles and values of the Istalian Nation and about the respect of the dignity of human beings. If Istalians, after their release, before to be able to vote to administrative as well as national elections, these people must demonstrate that they have learned and understood the values and principles of the State and must therefore pass examinations after a certain period of time, demonstrating their preparation and their adequate knowledge of these principles. |
