Details

Submitted by[?]: Democratic-Social Party

Status[?]: passed

Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: December 4642

Description[?]:

The President, Vice-President, Cabinet secretaries, Judges, Congressmen and all civil Officers of the Federal Republic of Likatonia shall be removed from office on Impeachment for and Conviction of, Treason, Bribery, Perjury, Dishonesty, Abuse of authority, Intimidation, Misuse of public funds or assets, Failure to supervise, Dereliction of duty, Unbecoming conduct, Refusal to obey a lawful order, Tax evasion, any other Ordinary Crimes and any other High Crimes and Misdemeanors.

Impeachment proceedings may be started by any member of the House of Representatives by presenting Articles of Impeachment to the House floor. The Speaker of the House must, then, remit said Articles to the House Judiciary and Ethics Committees, who must start a Formal Impeachment Inquiry, composed of several hearings and investigations. Afterward, both Committees must present a formal recommendation to the House floor, whether to Impeach or not to Impeach. Regardless of the recommendation issued by both Committees, the House shall vote whether to Impeach or not to Impeach. If the House votes to Impeach, a date must be set for a trial to take place in the House of Representatives. If the Impeachment Trial is brought against the President or the Vice-President or any member of the House of Representatives, it shall be presided by the Supreme Court Justices; if the Impeachment Trial is brought against any other Official, it shall be presided by a Commission composed by the Speaker of the House, the Secretary of Justice and the Chairs of the Judiciary, Ethics and House Rules Committees. During the Trial, the entire House of Representatives will act as the prosecutor and the jury, while the Impeached Official and its lawyers will act as the defendant. The Trial will proceed as any other regular Trial. At the end of the Trial, the House of Representatives shall vote and the Impeached Official will be Convicted by a two-thirds majority. The Convicted Official shall be immediately removed from office.

If the Convicted Official is the President, the Vice-President must take the oath of office. If the Convicted Official is the Vice-President, the President shall be given two months to present a new Vice-Presidential Nominee, who must be confirmed by the House of Representatives. If the Convicted Official is a member of the House of Representatives, the seat must remain vacant until the next election. If the Convicted Official is a Federal Judge or a Supreme Court Justice, the President will have two months to present a Nominee to the House of Representatives, who must be confirmed in a vote. If the Convicted Official is a Governor, the next person in the line of succession must take the oath of office. If the Convicted Official is any other civil Official, their office must remain vacant until the next election and its functions will be executed by a Temporary Officer appointed by the House of Representatives.

Furthermore, the Convicted Official shall be banned from running for any public office and shall face civil and/or criminal responsibility if applicable. If it is deemed that the public order has been breached or compromised, any party shall Call for Early Elections.

Abuse of Impeachment Rights by any member of the House of Representatives constitutes an impeachable offense.

To approve this right it will require a two-thirds majority vote because of its Constitutional implications.

Random quote: Henceforth, the current system of first and second class stamps, where the rich can pay to have their mail delivered faster than the poor, shall be BANNED. There shall be only one class of mail delivery, and ALL mail shall travel at the SAME speed for EVERYBODY. There can be no class discrimination in the People's Post Office! There must be the SAME class of mail service FOR ALL! ~ Friedrich Pfeiffer General Secretary of the Dorvish Communist Party
