Senators, It is our party's belief that a single head of state is required who shall oversee the republic, chair the executive, direct foreign policy and shall be our sole commander-in-chief. In this presidential-style system, the new head of state - who would be referred to as Taoiseach na Poblachta (Prime Minister of the Republic) - would replace the existing dual roles of President and Prime Minister. The Taoiseach would be elected by universal suffrage (currently every four years) and would have the exclusive prerogative to appoint the cabinet. However, there would need to be complete separation of powers between the Taoiseach and his cabinet (the executive) and the legislature (the senate). Therefore, as part of this proposal we suggest that it is the sole remit of elected senators to propose legislation in the senate and that members of the government cabinet - including the Taoiseach - may introduce legislation in the senate, but not vote in its favor. In addition, the executive powers of the Taoiseach would be continually scrutinised by the highest court in the land, ensuring the checks and balances on power remain very much in place. Articles I) Aontas Daonlathach Kirlawa (henceforth known as Kirlawa) shall have a single elected head of state known as the Taoiseach na Poblachta. II) The head of state shall be elected by universal suffrage by the adult citizens of Kirlawa using a two-round system and for a duration as established within Articles 5 and 13 of the Constitution (http://classic.particracy.net/viewconstitution.php?nationid=4) (currently every four years). III) Executive power shall be vested in the head of state. He/she shall represent the nation, guarantee its independence and see to it that the Constitution is observed. He/she shall direct foreign policy and be the commander-in-chief of the armed forces of Kirlawa. IV) The head of state will have the sole prerogative to propose the government cabinet, although the proposal must be approved by the Senate. V) The head of state shall be responsible for carrying into effect laws passed by the Senate and shall head Kirlawa's diplomatic corps, including the right to send and receive ambassadors. VI) The head of state shall have the power to issue executive orders, although such orders are the subject of judicial review and may be overturned if judged to be unconstitutional in line with Article IX of the Law of the Supreme Court (http://classic.particracy.net/viewbill.php?billid=616858). VII) The head of state has the power to determine Kirlawa's national budget. This will be conducted in conjunction with the Ministry of Finance and will be subject to approval by the Senate. VIII) As commander-in-chief, the head of state has the power to commit Kirlawa's armed forces into conflict; however, this may only be conducted once a formal declaration of war has been passed by the Senate. In cases of extreme emergency, the head of state must notify the Senate within 48 hours of commencement of hostilities. IX) In order to ensure a complete separation of powers between the executive and the legislature, no member of the government - cabinet member or official, including the Taoiseach - may vote legislation in the Senate, although they can still propose it. X) The head of state shall be entitled to a ceremonial guard formed of twelve guards; XI) The Taoiseach has the right to be addressed with the honorific title of Excellency. This bill establishes a presidential-style of government in Selucia, replacing the current semi-presidential-style system, and establishes a clear separation of powers between the executive and the legislature while ensuring checks and balances on executive power are in place through the Supreme Court. |
