| 1.) The Military and the Police as well as all other institutions of the state have to ensure that the SNYP (Selucian National Yeudish Party) remains in power. All these organisation have the duty to necessarily remove the elected government of the day if a different kind of government threatenes to harm the military or police or the framework of racial laws. 2.) The head of the military and police as well as all other state security organisations will by passage of this act must come from the SNYP and will appointed by the SNYP by declaration. 2.1) All members of the armed forces and public service must take an oath about their absolut and unconflicting loyalty to the SNYP. 3.) The head of the military and police as well as all other state security organisations has the right to call a state of emergency in any or every part of the country and to rule by proclamation.These proclamations can override the law and constitution. Any proclaimed law issued during a state of emergency could be made retrospective for four months to cover any emergency action taken by organs of the state. Such proclamations can suspend any act of the legislature and revoke any human and citizen rights. The length of a state of emergency is not restricted. A state of emergency must be renewed after each election. No member of the security forces or government can be held accountable for any of his action during a state of emergency. 3.1) The head of government and head of state and parliament only act as advisors to the head of the military and police as well as all other state security organisations. He is not liable nor responsible to anyone and completly exempted from persecution. 3.1. Persons can be detained indefinitly under a state of emergency. The use of any kind of force is allowed in such a situation. 4.0 This is a constitutional amendment and must be passed by a 2/3-majority and can be abolished by the same majority. |
