The Ministry of Environment and Tourism of Kirlawa would like to propose its government partners and specially, the Ministry of Education and Culture, the creation of the category Earraí ar díol spéise cultúrtha iad (EADSCI, Luthorian: Goods of Cultural Interest), to become a category of the heritage register in our nation. This category would include not only material heritage (cultural property), like monuments or movable works of art, but also intangible cultural heritage.

I. Sub-categories:
According to this law, the Government would create the following sub-categories for movable heritage:

The movable heritage designated as such may include archeological artefacts, archives and large works of art. Such protected objects may well be kept in a building which would be itself a EADSCI.

-Monument: those immovables that constitute architectural or engineering works, or works of colossal sculpture, whenever they have historical, artistic, scientific or social interest.

-Historical set: grouping of immovables that form a unit of settlement, continuous or dispersed, conditioned by a physical structure representative of the evolution of a human community for being a testimony of their culture or constituting a value of use and enjoyment for the community. Likewise, any individualized nucleus of properties included in a higher population unit that meets these same characteristics and can be clearly delimited

-Historical garden: Delimited space, product of the ordination by man of natural elements, sometimes complemented with factory structures, and estimated of interest according to its origin or historical past, or its aesthetic, sensory or botanical values

-Historical site (cultural landscapes): place or natural place, linked to events or memories of the past, popular traditions, cultural creations or nature, and works of man, which have historical, ethnological, paleontological or anthropological value.

-Archeological site: place or natural place where there are movable or immovable property susceptible of being studied with archaeological methodology, whether or not they have been extracted and whether they are on the surface, in the subsoil or under Kirlawan waters.

Under the Kirlawan system provinces may maintain their own registers of cultural heritage, Although disagreements between the regional and the national governments shall be solved by the Supreme Court. (e.g if a province wants to consider dueling as a cultural heritage but another doesn't, the registrer of both provinces will reflect so)

II. Codification:

All EADSCIs will have a code of type KW-XX-YYYYYYY-00000, where the first two digits indicate the type of good, and the next seven are the identification code of the same, with the last five digits being five generic zeroes, being able to change to identify parts of the same good.

The meaning of the first two characters is as follows:

AR: Files (Archives)
BI: Libraries.
MU: Museums.
51: Monument.
52: Historical garden.
53: Historical set.
54: Historical site.
55: Archaeological zone.
56: Architectural restoration.

III. Declaration

In accordance with the provisions of this law, in order for an asset to become part of the Catalog of Assets of Cultural Interest in Kirlawa, it is necessary that a file be initiated by the competent administration (although it can be done at the request of entities or particular). Once the file is opened, the legal protection provided for in the laws is applied to the asset, as a preventive measure.

The file is resolved by agreement, either by the Governing Council of the Province, by Decree (when this competence is transferred), or by the Council of Ministers at the proposal of the Ministry of Culture, by Taoiseach Decree.

Sites with prehistoric rock art and castles of Kirlawa and its ruins will be automatically declared EADSCI.

IV. Processing of the declaration

The declaration of a property as EADSCI requires the processing of a file, which must include a series of documents and specific information on the assets to be declared: cultural value of the proposed EADSCI, description and analysis of the proposed EADSCI, data of the EADSCI (style, author, conservation state, historical data, use...)

V. Consequences

-It will be in the public domain (distinguishing "public domain" from "private property", a private individual may own a EADSCI, but the Administration will protect the artistic, historical, spiritual value of the property)

-Authorizations for any work or modification will be needed (both in real estate - buildings - as well as furniture - a painting for example - that is, authorization will be needed to restore a painting and authorization to paint the facade of a EADSCI building)

- Will have an obligation to facilitate inspection, public visit and investigation (if the EADSCI is privately owned, the owner must facilitate its visit certain days a month - normally 4- for example, a castle owned by a Count must be opened to the public on certain days per month, previously agreed with the Administration

-It will have tax privileges. The owner of a EADSCI can receive aid for maintenance, restoration, etc.

-They are inseparable from their surroundings and inexportables. This includes movable property (paintings, jewelry), which is illegal to remove them from the country.

-In the case of immovables, it will be mandatory to write a special plan or protect them with any other figure of planning

VI. Sanctions

The law provides that the breach of the protection provided is an administrative infraction, susceptible to be penalized pecuniaryly, in addition to being able to compel to return the damages caused to its original state, on behalf of the offender.

The infractions can be of three types:

-Very serious: Penalty: four times the value of the damage. If it is not valuable, up to KDI 600,000. Prescription: 10 years

-Serious: Penalty: up to KDI 150,000. Prescription: 5 years

-Less serious: Penalty: up to KDI 60,000. Prescription: 5 years

In some cases, the actions can be constitutive of crime, and will be regulated by the Penal Code.
