Preamble:
A reflection in Rutania has been completed regarding the framework communities desire to manage and direct development. One element has been made clear: the status quo is not meeting the expectation of communities. Reforms in Shire and local government have made it necessary to define roles and empower decision making with regards to land use, transportation and environmental planning. This Law establishes a decentralized approach that aims to translate national priorities into territorial interventions adapted to each community’s particularities. The elaboration of this law has been guided by several principles.

These principles are:
1. Territorial planning is primarily a political responsibility.
There are many ways that a community can develop, and its effects are cumulative and give rise to a precise configuration and quality of life. Planning necessarily is a project that groups that aspirations for future that a community holds. Community development is a collective project, and decisions relating to its framework shall be made democratically.
2. Community planning is a shared power.
3. A coherent planning requires the coordination of choices and actions of all levels of government and a horizontal coherence between neighbours.
4. A more active participation of citizens in the managing and decision making of community planning ensures the sustainability of the process. Making decisions on a community’s future and its aspirations necessarily requires the consultation of its members. An open process involving citizens is to be ensured.

Article 1: Government Development and Transportation Policy
1.1 The government of Rutania shall prepare a statement of Government Development and Transportation Policy, outlining the objectives and priorities of the government, policies adopted by the government, and territorial interventions and project anticipated in the future by the government.
1.2. The preparation of the Government Development and Transportation Policy shall be the responsibility of the Ministry of Infrastructure and Transportation, in consultation with other ministries.
1.3 The Government Development and Transportation Policy shall be ratified by majority vote by the Parliament of Rutania.
1.4 The Government Development and Transportation Policy shall enter a process of revision after 10 years of its adoption, and a revised a Government Development and Transportation Policy before 15 years of the ratification of the previous Policy.

Article 2: Shire Planning Schemes
2.1 Each Shire shall adopt a Shire Planning Scheme defining the community development strategy of the Shire regarding land use, agriculture, environmental protection, inter- and intra-urban transportation and housing.
2.2 The Shire Planning Scheme shall contain a vision of development, orientations, objectives, implementation strategies and inscribe projects to attain the vision or considered conform to the planning framework.
2.3 The Ministry of Infrastructure and Transportation, in consultation with other ministries, shall study the conformity of the Shire Planning Scheme to the Government Development and Transportation Policy. The Planning Scheme shall only come into force after the approval of the Minister of Infrastructure and Transportation has been decreed.
2.4 The Shire Planning Scheme shall enter a process of revision after the adoption of a Government Development and Transportation Policy, and shall be completed in a delay of 5 years.

Article 3: Regional and Metropolitan Development Plan
3.1 Each county shall adopt a Regional Development Plan defining the development strategy regarding land use, agriculture, environmental protection, regional transportation and housing.
3.2 Each metropolitan government shall adopt a Metropolitan Development Plan defining the development strategy regarding land use, agriculture, environmental protection, regional transportation and housing.
3.3 The following provisions of article 4 shall apply equally to Regional Development Plans and to Metropolitan Development Plans:
3.4 The Development Plan must contain a Vision, Orientations, and objectives regarding the development of the intercommunal territory. Projects of metropolitan or regional importance and infrastructure networks of this scale shall equally be included.
3.5 The Shire government shall study the conformity of the Development Plan to the respective Shire Planning Scheme and to the Government Development and Transportation Policy. The Development Plan shall only come into force after the approval of the Shire government has been decreed
3.6 The Development Plan shall enter a process of revision after the adoption of the Shire Planning Scheme, and shall be completed in a delay of 5 years.

Article 4: Council Urban Plan
4.1 Each Council Authority shall adopt a Council Urban Plan applicable to the territory of the Council regarding land use, construction, environmental protection, local infrastructure, local transportation and housing.
4.2 The Council Urban Plan shall contain the regulations regarding zoning, constructions, land subdivision, urban design and landscaping, heritage protection as well as a transportation plan and climate change plan.
4.3 The relevant Metropolitan Government or County shall study the conformity of the Council Urban Plan to the pertinent Development Plan. The Council Urban Plan shall only enter into effect following adoption by the Metropolitan Government or County.
4.4 The Council Urban Plan shall enter a process of revision following the adoption of a Development Plan and shall be completed in a delay of 3 years.
