Preamble

The welfare and protection of domestic animals are of paramount importance to ensure their well-being and promote responsible ownership. This act aims to establish a comprehensive legal framework that safeguards the rights, health, and safety of domestic animals while outlining the responsibilities of owners, district governmental units, and Provincial Veterinary Offices. By implementing this legislation, we strive to foster a society that values and respects the welfare of domestic animals, ensuring their protection from cruelty, neglect, and exploitation.

Article 1: Title and Purpose

1.1. This act shall be known as the "Domestic Animals' Protection Act."

1.2. The purpose of this act is to:
a) Ensure the welfare and well-being of domestic animals;
b) Promote responsible ownership and proper care of domestic animals;
c) Regulate the registration of domestic animals to establish a comprehensive database;
d) Define the rights, responsibilities, and obligations of owners, district governmental units, and Provincial Veterinary Offices;
e) Establish punishments and repercussions for violations of domestic animal welfare laws.

Article 2: Definitions

2.1. For the purpose of this act, the following terms shall have the following meanings:
a) Domestic Animal: Any animal that has been domesticated and is kept or raised by humans for companionship, work, agricultural purposes, or any other lawful use.
b) Owner: Any person, organization, or entity legally responsible for the care, well-being, and supervision of a domestic animal.
c) District Governmental Unit: The administrative division responsible for overseeing and enforcing domestic animal welfare regulations within a specific district.
d) Provincial Veterinary Office: The government office responsible for the supervision, coordination, and implementation of domestic animal welfare policies and regulations at the provincial level.

Article 3: Registration of Animals

3.1. All owners of domestic animals shall be required to register their animals with the respective district governmental units.

3.2. The registration process shall include providing accurate information about the animal's identification, breed, age, vaccinations, and ownership details.

3.3. District governmental units shall maintain a comprehensive database of registered domestic animals to facilitate proper oversight, disease control, and enforcement of animal welfare regulations.

Article 4: Responsibilities

4.1. Owners shall have the following responsibilities:
a) Provide proper nutrition, housing, and veterinary care to ensure the well-being of their domestic animals.
b) Prevent cruelty, abuse, or neglect towards their domestic animals.
c) Exercise adequate control and supervision to prevent domestic animals from causing harm or nuisance to others or the environment.
d) Comply with all applicable domestic animal welfare laws, regulations, and guidelines.

4.2. District governmental units shall have the following responsibilities:
a) Enforce domestic animal welfare regulations within their jurisdiction.
b) Conduct inspections, investigations, and audits to ensure compliance with domestic animal welfare laws.
c) Provide education and awareness programs to promote responsible ownership and animal welfare.
d) Collaborate with Provincial Veterinary Offices to coordinate domestic animal welfare efforts.

4.3. Provincial Veterinary Offices shall have the following responsibilities:
a) Develop and implement policies, regulations, and guidelines for the protection and welfare of domestic animals.
b) Oversee the enforcement of domestic animal welfare laws at the provincial level.
c) Provide technical support, training, and resources to district governmental units.
d) Conduct research and promote advancements in domestic animal welfare.

Article 5: Punishments and Repercussions when in Violation

5.1. Violations of this act or any related regulations shall be subject to the following punishments:
a) For individuals:
- First offense: A fine of up to 15000 Kunos or imprisonment of up to five years, or both.
- Subsequent offenses: Increased fines and extended imprisonment as determined by the court.
b) For organizations or entities:
- First offense: A fine of up to 30000 Kunos,
- Subsequent offenses: Increased fines and additional penalties as determined by the court.

5.2. Additional and/or heightened fines and imprisonment durations shall be established by Provincial Assemblies based on the severity and nature of the violation.

Article 6: Implementation

6.1. The Ministry of the Environment and Energy, in coordination with the Provincial Governments through their respective Provincial Veterinary Offices, shall be responsible for the implementation and enforcement of this act.

6.2. The Ministry of the Environment and Energy shall issue guidelines and regulations necessary for the effective implementation of this act.

Article 7: Effectivity Clause

7.1 This act shall take effect fifteen (15) days after its publication in two newspapers of generalist nature and compliance with other requirements for its dissemination.
