| After witnessing our prosperous nation fall to the trap of corruption greed, it's judiciary weakened to be only puppets for the powerful to use for their twisted puppet and it is our duty as the Majatran beacon of prosperity to also root out corruption from within our institutions alongside economic and social favoritism that plagues our laissez-faire economy. As such, the Movement for Cultural Renaissance with the collaboration of the Judges and lawyers Federation for Fairness have been working hand and nail into creating the Judicial and Universal System for Transparency also known as the J.U.S.T plan. Act1: Balance of the Courts and Circuits 1) Given the fact that Beiteynu only has one Supreme Court to handle all matters, including economic and administrative disputes, which reveals itself to be severely holding back the court's effectiveness of handling certain matters alongside sever backchanneling from private and public entities trying to sway the judges in their favor, and in order to dealt with this we must: 1-a) Devolve the matters of the Supreme Court to solely focus on civilian affairs while two new courts will be created to handle administrative and economic affairs. 1-b) Creation of the Administrative Courts with the Administrators Court at its head, this new branch of the judiciary will handle all matters involving government institutions, such as a corruption investigation, internal party scandals, etc. This court will ensure that the administrative burden is lifted from the shoulders of the civilian Supreme Court alongside separating state affairs from the mundane disputes of the common folk. 1-c) The establishment of a judiciary solely responsible for handling economic matters is necessary in this day and age of laissez-faire economics that has ruled Beiteynu for the past millinea and in order to ensure that all economic disputes are treated fairly and equally a High Economic Court is necessary. This will make the process of settling disagreements between companies or private individuals more easily alongside reducing the bureaucracy needed without it clugging the mechanisms of the regular civilian Supreme Court. 2) Beiteynuese judicial circuits have long been dominated by the central one in Yishelem which makes the weight of the Judges in the national capital heavier than the ones in rural areas and other districts considered as unimportant to the central authorities. As such, the future circuits shall look like this: 2-a) The Endild district becomes home to its own circuit known as Crown Circuit, while two other circuits are formed using the remaining districts. 2-b) Both the Padika and Fosera districts shall form the Garden Circuit to ensure those two populous districts don't oppress the remaining two less populated districts 2-c) Both the Tadrika and Kokun districts shall form the Desert Circuit to ensure the equity of the trials for the two low populated districts. Act2: Fair and Impartial Rulings, F.A.I.R. act Given the radical nature of this law including its goals based on our own party's promise to bring justice which includes investigating the already existing party formally known as MF now named HHB alongside the private lobbyists in the knesset, this section of the plan shall include the following: 1) Parliamentary immunity lifted from any and all knesset members involved in a scandal alongside political immunity lifted from any government official also involved in a scandal of any degree following a court order from the Administrators Court. 2) Circuits and Supreme Courts shall investigated all matters no matter the level of government involvement with it except if said matter is considered sensitive to national security by the Ministry of Defense with the approval of local district governor. 3) To ensure pressure-free and safe environment for Judges alongside the magistrates, the Transparency Remediation Authority, TRA responsible for the appointment of Judges across the country alongside the magistrates in the three supreme courts that shall ensure the neutrality of judiciary. 4) the TRA will be able to launch criminal investigations into any individual or entity with enough suspicions and proofs to back their claims, the investigations must be approved by both the Ministry of Justice and the supreme court specialize in which matter the investigation is focused about, I.e A corruption investigation will need the approval of the Administrators Court, with the approval of the court capable of overruling any rejection from the Ministry of Justice. 5) Finally the Beiteynu judicial system shall be known as the 8 Gems System with the Supreme Court symbolizing the Gem of Harmony, the Administrators Court the gem of Law, and the High Economic Court the Gem of Fairness, the Ministry of Justice shall be the Gem of Order, the Transparency Remediation Authority will be the Gem of Clearvoyance, the Crown Circuit as the Gem of Prosperity, the Garden Circuit as the Gem of Life, and the Desert Circuit as the Gem of Hardship. |
