Article 1 - Outline

Paragraph 1: In the context of the Act, "devolution" is defined as the delegation of political authority from an higher level of government to a lower level of government.

Paragraph 2: The Imperial Parliament shall be responsible for determining devolution policies at the national level, and the ducal diets shall be responsible for such at the ducal level.


Article 2 - Devolution process
Paragraph 1: For the creation of new devolved institutions as well as their abolition, apart from the ones already existing upon the Ducal Institutions Reorganization Act of 5427 and Counties Establishment Act of 5430, an Act of Parliament outlining the institution(s) to be created must be passed.

Paragraph 2: For delegation of political authority to the devolved institutions and for the revocation of the delegated authority, an Act of Parliament mentioning the powers which would the ducal or county governments would be delegated by the national government must be passed.

Paragraph 3: Creation of new devolved institutions and abolition of existing ones requires two-thirds majority in the both Houses of Parliament, and the delegation and revocation of devolved political authority requires three-fifths majority.

Paragraph 4: For duchies to further devolve their delegated powers to the counties, as well as to revoke the delegated powers and reassume those powers themselves, an Act of ducal diet mentioning which powers would be delegated or revoked must be passed.

Paragraph 5: Delegation and revocation of devolved powers to counties by the duchies requires two-third majority within the respective ducal diet.

Paragraph 6: The exercise of devolved powers as well as the delegation and revocation of devolved authority shall be subject to judicial review by the Constitutional Court and the Ducal Supreme Courts.


Article 3 - Coming into effect
Paragraph 1: The Act shall come into effect immediately upon its approval in the Imperial Parliament.

Paragraph 2: The Act needs two-thirds majority to be passed and amended, and could be repealed with simple majority, subject to judicial review.
