WHEREAS the Government recognizes the importance of providing financial security and flexibility to citizens approaching retirement age, AND WHEREAS it is necessary to accommodate the diverse needs and preferences of retirees, whether they choose to continue working or fully retire, Section 1: Title and Commencement 1.1 This Act shall be known as the "Retirement Age Flexibility and Pensioner Employment Act." 1.2 This Act shall come into force on the 1st of February 5530. SECTION 2: Definitions For the purposes of this Act: 2.1 "Legal Retirement Age" shall refer to the age at which a person is entitled to begin receiving full pension benefits from the public pension system, which shall remain at 60 years old. 2.2 "Flex System" shall refer to a flexible employment arrangement for individuals who have reached the Legal Retirement Age and wish to continue working on a part-time or occasional basis. 2.3 "Public Pension Option" shall refer to the government-administered pension scheme available to eligible citizens. 2.4 "Private Pension Option" shall refer to pension plans administered by private employers or financial institutions, separate from the Public Pension Option. 2.5 "Pension" shall refer to the periodic payments made to individuals who have retired and are eligible under the Public Pension Option. 2.6 "Employer" shall refer to any individual or entity that hires employees to perform work, including but not limited to, businesses, non-profit organizations, and government agencies. SECTION 3: Maintenance of Legal Retirement Age 3.1 The Legal Retirement Age shall remain fixed at 60 years old. 3.2 Individuals reaching the Legal Retirement Age shall have the option to retire and begin receiving their pension or continue working under the Flex System as outlined in this Act. SECTION 4: Establishment of the Flex System 4.1 Individuals who have reached the Legal Retirement Age and are subscribed to the Public Pension Option may opt into the Flex System. 4.2 Under the Flex System, pensioners may choose to work part-time or on an occasional basis, with the following provisions: (a). On days when they are employed, they shall not receive their pension benefits for that day. (b). On days when they are not employed, they shall receive their pension benefits for that day. (c). Individuals may delay their full retirement and continue working according to their own choosing, without any obligation to retire at a specific age beyond 60. 4.3 Employers may not use the Flex System for full-time employment purposes. 4.4 The minimum employment under the Flex System shall be set at 4 hours per week and may extend up to a maximum of 32 hours per week. 4.5 Pensioners employed under the Flex System for less than 25 hours per week shall be eligible for a tax-exempt status on their earned income from such employment. 4.6 Pensioners with Private Pension Options shall not be eligible for the full benefits of the Flex System as defined in this Act, but may engage in part-time work under terms agreed upon with their employers, subject to this Act's limitations. SECTION 5: Job Training Initiatives for Pensioners 5.1 The Government shall establish job training programs designed to help pensioners who wish to continue working but are unable to do so in their previous occupation due to health or other limitations. 5.2 These training programs shall focus on matching pensioners with jobs that are appropriate for their current health standards and physical capabilities. 5.3 Pensioners who complete job training programs shall be offered employment opportunities that align with their new skills and health status. 5.4 Employers participating in these job training initiatives shall be eligible for government incentives, including but not limited to, tax credits and subsidies. SECTION 6: Implementation and Oversight 6.1 The Ministry of Labor, in coordination with the Ministry of Finance and the Ministry of Social Services, shall be responsible for the implementation and enforcement of the provisions of this Act. 6.2 The Ministry of Labor shall monitor the employment patterns of pensioners under the Flex System and report annually on its impact on the workforce and pension system. 6.3 Employers must report the working hours of pensioners employed under the Flex System to ensure compliance with this Act. 6.4 The Ministry of Labor shall oversee the job training initiatives, ensuring they are accessible and effectively matched to the needs of pensioners. SECTION 7: Enforcement and Penalties 7.1 Employers found in violation of the provisions regarding the Flex System, particularly with respect to full-time employment and hour limitations, shall be subject to penalties as outlined in the Employment Act. 7.2 Pensioners found to be abusing the tax-exempt status by misreporting their hours or income may face penalties, including the repayment of tax benefits received. SECTION 8: Review and Amendments 8.1 The provisions of this Act shall be reviewed every two years by the Ministry of Labor and the Ministry of Finance to ensure they meet the evolving needs of the workforce and retirees. 8.2 The Government reserves the right to amend this Act as necessary to address changes in economic conditions, labor market demands, and public health considerations. |
