This resolution sums up my view on the Judicial Branch question as I see it. This resolution is heavily based on the Party of Liberty and Prosperity's idea.This party is situated in Kalistan. Well, here it goes: This resolution allows for the formation of a National Constitutional Court that shall operate under the following guidelines. 1. The National Constitutional Court (from here on to be called NCC) is to be a body independent of the Parliament and the Prime Minister in its rulings and decisions. 2. 3/4 positive majority may outrule the NCC, however, if a party contains over 60% of the seats then this article shall be null and void. 3. The number of Justices of the NCC shall always be two more than the number of registered parties in the Nation. 4. The Justices shall be elected after every other election, for a term that is equivalent to twice that of the legislative and Presidential term. 5a. Each registered party in the Nation shall receive the privilege of electing ONE Justice to represent the elector or any other party of the elector's choosing. 5c. The party that holds the post of Head of Government shall have the privilige of electing ONE additional Justice to represent the elector or any other party of the elector's choosing 5e. The party that holds the most seats in Parliament but does NOT hold the post of Head of Government shall have the privilege of electing ONE additional Justice to represent the elector or any other party of the elector's choosing. 5d. In the case that the regular number of Justices is divisible by two and there is a tie, the Justice(s) elected by the party holding the post of Minister of Justice shall cast the tie-breaking vote. 6. Each party has the right to submit a case per legislative term to the NCC for the Court's review. 7. A simple majority of votes from the Justices must happen for a decision to be taken 8. A ruling of the NCC shall be final and utter and cannot be appealed. ---Additional Notes--- * The NCC only has the power to enforce rulings that are based on RP concepts and elements that are not physically built into the game. Although rulings based on the actual game system can be made, they cannot be enforced and it is up to the players to follow these rulings. *The NCC shall operate ingame and if any unconstitutional act has been committed then the party must create a bill regarding the case for debate and voting. The voting shall be made by means of the debate. *Any party that veto's an NCC decision or passes a whole legislative term without submitting the name of a Justice, that party shall be punished with the charge of obstruction to Justice *If the NCC decides to call early elections or requires a war declaration to be created then the Head of state or Head of government shall certify that this happens and all parties vote as the NCC has decided. |
