What if the person that goes on trial is actually innocent of the crime(s) that he or she was charged with. Assuming everyone that goes to trial is automatically a "criminal" is reckless. And heck, one could say that you are enforcing a sort of class segregation by denying those that cannot afford council what they should be provided. |
