Message | How do you prevent malicious prosecution. The woman goes to a doctor, he tells her that she has to lose weight before he will perform the cosmetic surgery, so she sues him. ((The options are horrible though. I am going to suggest an option that malpractice prosecutions can only be brought with the support of other medical doctors. As it stands this is the best option.)) |

Message | I agree that fraud is possible. However, at the moment, I see this option as the lesser of two evils. If death occurs, obviously someone should pay if they are responsible for it. But what if someone becomes paralyzed? What if they sustain brain damage? There are many possible scenarios that are very bad, but not fatal... |

Message | I feel this could have grievous implications for the medical profession. Doctors may grow so scared of being found to have committed a 'malpractice' that they may simply give up being doctors and move onto a profession where they are less likely to face civil/criminal legal action for misinterpreted mistakes. I believe the best way for doctors to be held accountable is through the creation of professional boards who would hold an enquiry on the conduct of a doctor if their employer or the family of a victim feel it is necessary. This board should be empowered to deprive doctors of their license if they are found to have committed a malpractice. This way, doctors are 'tried' by their professional peers who have a far greater understanding of medical procedure than the law courts will. Thus I oppose. |
