While it is recognised that financial penalties are effective deterrants to some forms of crime, it should also be recognised that excessive and unjustified awards of damages not only cause ireperable harm to our economy, but also are the cause of many unsubstantiated claims for damages.

Taking this into consideration we propose that any claim for damages be limited to the total of:
Recovery of legal costs plus
Recovery of lost income plus
Restitution of other proven financial losses plus
a maximum of 6 times the plaintiff's average mothly income over the previous 12 months in punitive damages.

Where the plaintiff is a corporation or association, this punitive value shall not exceed 6 times the average national monthly income per capita.

MessageThe terms of the law specify only tort, not specifically medical tort. Corporations and associations can suffer financial loss through the illegal actions of others. As such they can be victims in tort and seek recompense in law.

(It can be that the person who drafted these law options, did not understand the vocabulary they chose to use.)
