Description[?]:

No one should ever be handed over to the authority of a nation that engages in barbaric practices against their prisoners. Therefore we propose to outlaw extradition to countries with capital punishment or with a record of cruel or inhuman treatment of suspects and convicts.

However, if the nation seeking extradition practices capital punishment but does not otherwise engage in cruelty, extradition may be allowed provided they agree to not use it in that instance. And for cases where extradition is denied but the law a person is accused of breaking elsewhere is similar to the law in the Kundrati Union, a system will be created to allow other nations to bring charges against suspects before our courts to face punishment in our justice system.

MessageWe have huge, and I mean HUGE reserves about this. Some in the states may have heard of this. This summer, a Hispanic man killed two cops here in Denver, CO. He fled capture, and made his way to Mexico. Now, Mexico does not extradite to countries with the Death Penalty. Thusly, this murderous scum just got off essentially scott free for the brutal killing of two police officers because of extradition laws like this. Do we want to be a haven for criminals flee capture for their brutal crimes?

MessageIm thinking that there will probably be a need for a clause. Perhaps, instead of extraditioning them -- we can work it out with the nation the law was offending in, and thusly they can be brought to punishment through our own system. That way, we avoid such problems as you mentioned NS.

MessageWe're divided about this. On the one hand, we support capital punishment even in Kundrati itself, so we would not refuse extradition to a country that has it. On the other hand, we do not support torture or other forms of 'cruel and inhumane treatment of prisoners'. We'll have to think about this for a bit.

MessageWe support this bill, but only have a problem with one line.

The Capitalist Freedom Party believes it more trouble than beneficial to have to keep check that such promises are being filled out. And in the meantime we find it to be rude to blatently request that they cater for our citizens "specially". Thus, ultimately since it would leave a stain on our international reputation for our attitude toward others, and even if they were to agree, the powers of this government would hardly have the right to keep check on other's judicial instititions, let alone the ability.

Remove this line, and you will recieve the "aye" vote from the Capitalist Freedom Party.

MessageIf the bill were modified to "Extradition to nations that practice cruel or inhuman treatment of suspects or in punishment is not allowed." we'll support it. Otherwise our stance on capital punishment would oblige us to vote 'no'.

MessageCFP - clauses such as that are often part of extradition treaties between death penalty and non-death penalty nations in the real world. For example, the US-EU extradition agreement contains this clause:

"ARTICLE 13
Capital Punishment

Where the offence for which extradition is sought is punishable by death under the laws in the requesting State and not punishable by death under the laws in the requested State, the requested State may grant extradition on the condition that the death penalty shall not be imposed on the person sought, or if for procedural reasons such condition cannot be complied with by the requesting State, on condition that the death penalty if imposed shall not be carried out. If the requesting State accepts extradition subject to conditions pursuant to this Article, it shall comply with the conditions. If the requesting State does not accept the conditions, the request for extradition may be denied."

And the states involved keep their promises because to do otherwise is to break a treaty and will result in diplomatic consequences, along with a high probability of not being able to have anyone else extradited in the future.
