SEC 1. FINDINGS 1) Nova Terra is a terrorist organization, as most recently evidenced by its recent publication urging people to assassinate the sovereign ruler of the Holy Luthori Empire, and the elected ruler of the Federation of Zardugal. (Link) http://forum.particracy.net/viewtopic.php?f=13&t=93 2) The Holy Luthori Empire and the Federation of Zardugal are respected allies of the Darnussian Democratic Republic 3) The operation of terrorist organizations is unacceptable in a civilized society. SEC 2. DECLARATION OF TERRORIST ORGANIZATION 1) Nova Terra, and it's affiliates, associates and associated bodies are deemed "Terrorist Organizations," as that term is defined under Darnussian law. 2) It shall be a Class 1 Felony, punishable by up to 30 years in prison, to give tangible aid or assistance, or attempt to do the same, to a Terrorist or a Terrorist Organization. 3) It shall be a Class 1 Felony, punishable by up to 25 years in prison, for any Darnussian citizen to voluntarily belong to a paramilitary organization. SEC 3. RECONCILIATION WITH BASIC CONSTITUTIONAL RIGHTS 1) Nothing in this provision of law shall be deemed to infringe upon the right of Darnussian citizens to expose a philosophy supportive of a Terrorist Organization, through the peaceful use of their freedom of speech. 2) Nothing in this provision of law shall be deemed to infringe upon the right of Darnussian citizens to vote for, or donate money to, the political branch of an organization listed as a Terrorist Organization. SEC 4. POLITICAL BRANCHES OF TERRORIST ORGANIZATIONS 1) Recognizing that the people have the right to peacefully practice any political belief they wish, the donation of funds to, or the use of funds by, a political branch of a terrorist organization shall not be a crime, so long as the other provisions of this Section are complied with. 2) Upon demand of any officer of the Cabinet upon any political party, such party must reveal what they have spent their funding on, truthfully and accurately. If it is found by a court of competent jurisdiction that any such funding has gone to support acts of terrorism, domestically or abroad, the persons responsible for directing such funding to terrorist actions shall be convicted of Giving Aid to Terrorists, as listed in Section 2, and the Political Party responsible for the same shall have its accounts frozen indefinitely. 3) For purposes of this act, an Act of Terrorism shall be defined as the intentional and unlawful destruction of any property, the assassination of any domestic or foreign official, the intentional and unlawful detonation of any explosive device having a force greater than six ounces of TNT, the intentional and unlawful use of any device, machine, chemical or life form to inflict grievous bodily harm on a group of people, or the intentional and unlawful detention of any person or persons. Unlawful, for purposes of this definition, shall mean that no legal excuse or justification existed at the time the action took place, under the law of the place where the action occurred. |
