Imagine you are a CEO of a large company where you know there is widespread, institutional prejudice against people of a certain race or gender. You know this is morally unjust, and that in the long-run it will hamper your organisation's success by failing to make the most of the talents of all your employees. But how do you go about turning that culture around? What do you do? Positive discrimination is an unattractive and clumsy policy, but if organisational leaders are serious about combatting bigotry by getting more under-representated groups employed, then it may be the least worst option available. How else do you get your recruitment officers - with all their prejudices - to give a chance to someone who is being unfairly judged because of their background? We don't like positive discrimination and we hope it will never become a permanent fixture. However, it may be responsibly used as a short-to-medium term strategy to get people from minorities into key positions and so begin the process of building mutual trust and whittling down prejudices. Message | This Act would not specify whether an organisation should use positive discrimination, nor, if so, how long it should be used as a policy. What it will do is lift the threat of criminal prosecution from an employer who practices positive discrimination as a means towards achieving greater equality of opportunity for workers who face discrimination because of their backgrounds.
