Bill: Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs
Details
Submitted by[?]: Interim National Democratic Congress
Status[?]: passed
Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.
Voting deadline: April 3421
Description[?]:
We wish to grant the accused Valruzian soldiers who entered and committed illegal acts on Deltarian soil, a completely fair and just trial We ensure that these soldiers won't get the Death Penalty, but, the Valruzian Empire has to accept that our sovereignty was infringed upon. RESULT The following has been established: 1. The hostage "crisis", was a minor law & order situation which was managed by the Naban Police and at the most left Valruzian citizens were stranded for some hours at the airport 2. The soldiers of Deltaria, were acting under the orders of the Valruzian Govt which was under the Imperial Libertarian Party of Valruzia. 3. The Valruzian Govt which was under the Imperial Libertarian Party of Valruzia at the time did't contact the Deltarian Government over the matter and went with the media frenzy 4. They, thus, infringed upon the Sovereignty of Deltaria 5. However, their purpose was not to inflict harm and only to "save" the Valruzian citizens, who were already safe 6. They committed no crimes against humanity. The VERDICT: The Valruzian Govt which was under the Imperial Libertarian Party of Valruzia has apologized. Both the Imperial Libertarian Party of Valruzia and the Revolutionary Party of Valruzia which are the 2 largest parties in Valruzia regret the incident as a misunderstanding and have assured that the trado embargo is revoked. The National Forum officially recommended a 5-year term, if the Valruzian Nation doesn't regret the issue and assure respect for our sovereignty. But, the soldiers have been in prison for 15 years and the Valruzian Nation have also given their support and hope for reconciliation. Thus, this court orders the release of the 15 Valruzian soldiers back to their land. This court also acknowledges the role of the DBSM in this issue and recommends that the Deltarian Government start a trial as soon as possible. -Dr. George Mathias, Presiding Judge Deltarian Foreign Minister, NC Founder-President Signed, George Thorke Chief Justice Of Deltaria PLEASE NOTE: The decision has been made and a vote by the National Forum will only be an acknowledgement of the judgement, made in conjuction with the Supreme Court of Deltaria. The soldiers are being released by order of the Premier and Foreign Ministry. |

Message | To the proponents of the death penalty, The Valruzian soldiers had acted upon orders. They were ordered to 'save' the hostages. During this process that they didn't commit any inhumane atrocity or killed anyone. There was no bloodshed whatsoever. Thus, the death penalty is out of question. Deltarian law says that: 'The death penalty is not applied, except for terrorism and crimes against mankind.' Unless, proponents of the death penalty are able to provide concrete evidence of such acts by these soldiers, the death penalty is out of question. - Dr. George Mathias Presiding judge, Deltarian Foreign Minister, NC Founder-President |

Message | Prosecution Plea 1: BACKGROUND: About 15 to 17 years ago, a quasi-hostage crisis had erupted in which a number of Valruzian citizens in Naban, Deltaria were held against their will. The reason we say quasi is a photo which depicts the so called 'hostages' in a news story published by the Valruzian Media Syndicate called 'Hostage Situation In Deltaria', which depicts the 'hostages' just temporarily starnded in the airport, are comfortable enough and not in great distress. Exhbit A - http://forum.particracy.net/viewtopic.php?f=17&t=1977&hilit=valruzia&start=70 'Hostage Situation In Deltaria' The fact is that at the time the DBSM fabricated false media stories that it had engaged in a successful coup, but not such thing had happened. They were simpy causing huge law and order problems in Naban, which also including stone pelting at the Valruzian Embassy and a huge violent protest at the airport. But, the Deltarian Security Forces and the Naban City Police managed the situation. Thus, there was no true 'hostage' situation in the first place, the kind of which in there are captors and torture. It was just an inconvenience. THE ACT: Instead of officially getting in touch with the Deltarian government at the time, the Valruzian Empire relied on the half-baked and exaggerated reports of the DBSM. As it is known, all Valruzian citizens who wished to depart at the moment, eventually did leave Deltaria as soon as the law and order situation in Deltaria improved. But, the Valruzian Empire reacted rashly and with half-knowledge and ordered troops into Deltaria, which landed at a spot and very immediatelt captured for non-authorized entry. Aftermath and just solution to the issue: Sadly, these soldiers have since then been in prison. But, the Valruzian Empire media and newspapers have fabricated stories claiming that the prisoners are kept in bad conditions. This isn't true as Deltaria has ratified the 'Convention on the Humane Treatment of Prisoners of War'. -. http://classic.particracy.net/viewtreaty.php?treatyid=57 The FDR Prosecution demands an apology on behalf of the government present in Valruzia in the mid-3400s by the present government of Valruzia, as this issue has escalated unnecessarily. As soon as an official announcement is made for an apology, the Deltarian government will release the prisoners. |

Message | Prosecution plea 2: The Valruzian Empire has labelled Deltaria as an unstable and a rogue nation. While Valruzia has evicted our citizens, we still have allowed Valruzian citizens in Deltaria. We also demand the Trade embargo to end on both sides (the Valruzias ending their embargo first) and the reutn of the Deltarians who were living in Valruzia. - James Berkley Chief Prosecutor Former Foreign Minister Of Deltaria |

Message | Defence Plea 1 The Deltarian Government has to stop acting like hypocrites. If members of the Deltarian Armed Forces were held by a foreign nation after such catastrophic events as the embassy assault and threatened with death, would Detaria not behave the same as Valruzia has done? The lawlessness in Naban promoted the strong response from the Valruzian government. The Deltarian Government's demand for an apology and recent belligerent actions such as the 'monitoring' have provoked a just response. Deltaria needs to get over the past and punish the Blue Shirt thugs who are to blame for much of this not to disturb a socialist nation building a new utopia. Josh Steel Chief of the Valruzian Defence Team |
Date | 11:26:57, January 01, 2013 CET | From | Interim National Democratic Congress | To | Debating the Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs |
Message | The DBSM has disbanded and they've been dealt with as per Deltarian law. As per the accusations of Mr. Steel we'll counter them point to point: No, the Deltarian government would've first informed the Valruzian government of a such an issue. Also, the Valruzian citizens were safe and the issue under control of the Naban police. We do not know of what 'monitoring' you're talking about. We really feel sad for the patriotic Valruzian soldiers, that their own government believes that they're being 'disturbed', while they face charges here in Deltaria |
Date | 11:39:41, January 01, 2013 CET | From | Interim National Democratic Congress | To | Debating the Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs |
Message | The FDR believes that Deltarian sovereignty was infringed upon and the Valruzian Empire didn't deem it necessary to inform the Deltarian government. The FDR has proved that the issue was under control and the Valruzian citizens were under no extreme threat, at least not one which the Naban Police couldn't handle. Now, the FDR seems to not have violated any Human Rights issues, rather, it ensured that the Valruzian citizens were safe. It would've been a different issue if any citizens were armed. Despite the opinions of the defence, the fact remains that the FDR has proved that: 1. there was no extreme threat which called for outside intervention 2. The Valruzian empire didn't inform or warn the Deltarian government Unless, the Valruzian Empire has any other reason for ordering soldiers in Deltaria, we deem the FDR completely innocent and the Valruzian Empire culpable for rash actions, for which they should apologise at least on behalf of the government in Valruzian at the time. Dr. George Mathias, Presiding judge |
Date | 19:27:10, January 01, 2013 CET | From | Demokratychna Delic Partija | To | Debating the Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs |
Message | According to Deltarian Law the death penalty is reserved for terrorism and crimes against mankind, and as far as im concerned unless Valruzia wants to define their soldiers actions as an act of war it was an act of Terrorism deserving the Death penalty. To say that these soldiers were just following orders as an excuse for their actions is foolish, as soldiers they know they risk their lives in their duties, It is my opinon that a reminder of death will prevent future actions such as this. Henry Poteat Former Deltarian Premier representing the Whig Party. |

Message | http://classic.particracy.net/viewnews.php?newsid=364770 This is the monitoring the FRD President's Office notified us of. It seems the governing powers of Deltaria are divided and not producing a coherent and united response to this issue. This judgement we belive is highly premature and not fair at all. We propose that a third neutral judge be asked to look into the issue. The People's Republic of Valruzia believes that the lack of a government in the FRD is the main cause of the confusion. We have heard hawkish and dovish positions from all sides of the Deltarian political spectrum. We feel that this is election posturing and think that responsible negotiations will probably start after your elections in 3421. |

Message | To the members of the Valruzian Nation, The Deltarian prosecution has provided proof and thus proved that: 1 there wasn't any real threat which called for such military action 2 no talks were held with the Deltarian government This court shall only accept objective points in this matter no subjective opinions. Also, let us remind the Valruzian Nation, that the Conservatives previously wanted to execute the prisoners. It is the NC and me that negotiated and decided that IF AND ONLY IF Valruzia doesnt apologise OR is able to prove or disprove something objectively in this court, we'll sadly have to grant a 5 year sentence to the soldiers. Now, we request the Valruzian nation to present any more proof or evidence or any pivotal point, or apologise to the the FDR Dr. George Mathias Presiding judge Founder-president NC |

Message | What "crime" have our soldiers committed? We have landed on your shores with the intention of freeing our citizens without bloodshed. There were no casualties. Why can't we treat these men as illegal aliens and return them to their country of origin. On a side note, these soldiers have been trapped in Deltaria for over 15 years in one of your prisons. Surely they have served their sentence by now. |
Date | 19:35:49, January 02, 2013 CET | From | Interim National Democratic Congress | To | Debating the Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs |
Message | The Valruzian nation is right, therefore the Valruzian Government should apologize al least to the soldiers. Is not true that the Valruzian nation accepts, that the govenment at the time, sent their own troops for an unnecessary and rash mission? Valruzia is a nation, it can't be irresponsible on such matters. The Valruzian state should issue an apology to the 15 soldiers, for their decision taken rashly. |

Date | 20:38:34, January 02, 2013 CET | From | Interim National Democratic Congress | To | Debating the Valruzian Empire VS. FRD Trial under the Minister For Foreign Affairs |
Message | "Of course we'll apologize to our own troops. We sent them on a recovery mission which was supposed to liberate our stranded troops, which were held there by forces of a military coup that was set about by the DBSM. Would Deltaria not do everything in their power to get their people back home safely? We Valruzians take that sort of commitment to our people very seriously, and this is the result. We are prepared to lift the embargo and other such measures upon the return of our men back to Valruzia. After spending over 15 years in a Deltarian prison, I think they'd like to get back home, and that we definitely owe them an apology at the very least for our act of desperation." This was the humble reply of the Imperialist Party. We're releasing the soldiers as soon as the Valruzian Government promises that it shall not take such rash decisions again, or at least try to communicate with the Deltarian Government. |

Random fact: Players consent to the reasonable and predictable consequences of the role-play they consent to. For example, players who role-play their characters as committing criminal offences should expect those characters to experience the predictable judicial consequences of that. |
