AN ACT to decentralise the regulation of fireworks to local governments in order to better accommodate cultural differences between Hulstria and Gao-Soto.

BE IT ENACTED by His Imperial and Most Illustrous Luthoran Majesty, Kaiser Otto of Hulstria, and His Imperial and Heavenly Majesty, Mikado Okatori Akihiko of Gao-Soto, by and with the advice and consent of the Imperial Diet and Imperial Courts of Hulstria and Gao-Soto, at Kien assembled, and by the authority of the same, as follows-

1) Principles of firework regulation policy
(1) Notwithstanding any provisions made by local governments, the handling by and sale to underage individuals of strong fireworks shall be forbidden;
(2) Notwithstanding any provisions made by local governments, fireworks with sufficient force to cause avalanches and inflict damage to property shall be reserved for professionals.

2) Local government discretion
(1) Taking into account the principles set out in section 1, it shall be for each Crownland Diet to pass laws on the regulation of fireworks;
(2) This responsibility shall confer upon the local governments the right to issue and withdraw permits and qualifications for the sale, large-scale use and professional handling of fireworks; the right to determine and maintain lists of the fireworks allowed to be sold within the borders of the Crownland; and to regulate and restrict their use in terms of time and place where necessary for the public order or safety.
(3) Any local government that has legalised any form of fireworks shall engage, from time to time, in activities to promote awareness of the dangers of the use of fireworks.

My party believes in subsidiarity: the principle that public policy is best made as close to the citizen as possible. To better reflect that, we are presenting a package of bills, of which this is the first, in areas where we believe Crownlands and Gemeinden will be better able to deal with the situation than us here in Kien.

Where I come from, in Mitrania, there is an interesting situation that arises around the start of each year: there are conflicting interests between the safety of our homes, which would benefit from the laws as they currently are because of the danger of avalanches being triggered by large fireworks, and our Gao-Showan culture which attaches special significance to fireworks at the new year. They are, in a sense, as much a part of the region as Älplerhorns and Jodeling. Now this is a dilemma not heard in Kien, and rightly so because if we had to address every single regional problem, we would slip into particularism.

But my point, Gicho-san, is this: dilemmas like these arise in firework regulation across the Crownlands. We cannot offer the regions the detailed and tailored regulation they deserve. So why are we still regulating this? I argue that we should give my home Crownland the power to issue permits and make regulations that really balance the need of the region.

Of course, there are safety aspects. Of course, though the current government in Mitrania is eminently sensible (laughter from the HDV benches), some parties might want to compromise the safety of my children and, for example, legalise the sale of fireworks to them as well. In the present bill, we have addressed that by introducing principles as a framework within which the tailored policy can be made.

I hope the House will vote for this bill, so that the Crownland Diets can get cracking on this; it will make us feel all the more safe and proud of our heritage, both at home in Takkental and in similar regions across the Crownlands.
