Bill: Reform of Appeals Act
Details
Submitted by[?]: Radical Democratic Party
Status[?]: defeated
Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.
Voting deadline: November 2162
Description[?]:
The right of appeal is being abused in Indrala's court system. Losing parties are adept to appeal any adverse judgment on flimsy or even frivolous grounds. This works against poorer parties in particular, as they are less able to afford multiple appeals, and therefore likelier to accept unfavorable settlements. Therefore, the RDP proposes that the right of appeal be limited to situations where, in the opinion of the appellate court, a miscarriage of justice may have existed. |
Proposals
Article 1
Proposal[?] to change The right to appeal against a judgement rendered by a court.
Old value:: Every person has the right to appeal against a judgement and to have it reviewed by a higher court.
Current: Every person has the right to appeal against a judgement and to have it reviewed by a higher court.
Proposed: Judgements may only be appealed against for grave procedural errors.

Message | We will oppose this. |

Message | Yet again, the description is at odds with the formal provisions. A miscarriage of justice may be revealed by fresh evidence, yet the proposal only allows appeals for procedural errors. |

Message | OOC: Wouldn't fresh evidence result in a retrial rather than an appeal? |
